What were the facts?

The assessee, M/s. Alstom T & D India Ltd., filed an appeal before the High Court of Judicature at Madras against an order dated 03.11.2008 passed by the Income Tax Appellate Tribunal (ITAT), Chennai. The appeal pertains to the assessment year 2002-03. The ITAT's order was challenged on two substantial questions of law concerning the disallowance of provision for contract contingencies. During the pendency of the appeal, the assessee filed a declaration under the Vivad Se Vishwas Scheme on 19.11.2020 and was awaiting orders. The High Court noted this subsequent event and directed the Competent Authority to process the application under the Direct Tax Vivad Se Vishwas Act, 2020.

Whether, on the facts and in the circumstances of the case, the Income Tax Appellate Tribunal was right in law in holding that the provision for contract contingencies are unascertained liability and liable to be disallowed? (Question of law) 2. Whether, on the facts and in the circumstances of the case, the Income Tax Appellate Tribunal was right in law in following the decision of the Tribunal without appreciating the distinction of facts in respect of provision for contract contingencies?
