What did the High Court hold?

The High Court noted that the assessee intended to avail the benefit of the Vivad Se Vishwas Scheme, 2020. Consequently, the Court found it unnecessary to decide the substantial questions of law raised in the appeal. The Court directed the appellant/assessee to file Form No.I under the Vivad Se Vishwas Scheme on or before 11.11.2020. Upon filing the declaration, the competent authority was directed to process the application expeditiously, preferably within eight weeks. The Court also granted liberty to the assessee to restore the appeal if the decision on the declaration was not in their favour. With these directions, the Tax Case Appeal was disposed of, leaving the substantial questions of law open. No costs were awarded.

What were the facts?

The assessee, M/s. Dinamalar Tamil Daily, filed a Tax Case Appeal before the High Court of Judicature at Madras against an order of the Income Tax Appellate Tribunal, Madras 'B' Bench, dated 28.11.2014. The appeal pertained to Assessment Year 2006-07. The dispute involved the charging of interest under Section 234A of the Income Tax Act, 1961. The assessee contended that interest should be charged for 16 months, not 17 months, as the self-assessment tax paid in February 2008 compensated for any revenue loss. The revenue, represented by the Joint Commissioner of Income Tax, Circle I, Tirunelveli, had a different stand. During the pendency of the appeal, the assessee expressed an intention to avail the benefit of the Vivad Se Vishwas Scheme, 2020.

What were the issues?

1. Whether the Appellate Tribunal was correct in law in approving the respondent's stand in charging interest under Section 234A of the Income Tax Act, 1961, for 17 months instead of 16 months, considering the self-assessment tax paid in February 2008 which allegedly established no loss of revenue for March 2008. 2. Whether the Tribunal was correct in law in sustaining the levy of interest under Section 234A of the Act, including the period of March 2008, even though the payment of self-assessment tax in February 2008 compensated for the loss, thereby vitiating the levy for March 2008. Assessee's Contentions: The assessee argued that interest under Section 234A should be calculated for 16 months, not 17 months, because the self-assessment tax paid in February 2008 covered any revenue shortfall for March 2008. The assessee also stated its intention to avail the benefit of the Vivad Se Vishwas Scheme. Revenue's Contentions: The judgment does not record specific contentions made by the revenue regarding the levy of interest under Section 234A.
