THE COMMSSIONER OF INCOME vs. M/S. DURR INDIA PVT LTD
What did the High Court hold?
The High Court did not decide the substantial questions of law on merits. The learned counsel for the appellant/Revenue brought to the court's notice Circular No.17/2019 dated 08.08.2019 issued by the Central Board of Direct Taxes (CBDT). This circular stipulates that appeals shall not be filed or pursued by the Department before the High Court if the tax effect does not exceed Rs.1,00,00,000/-. The Revenue submitted that the tax effect in these appeals was less than this threshold limit. Consequently, the High Court dismissed the present appeals as withdrawn, stating that the substantial questions of law were kept open for determination in appropriate cases. No costs were awarded.
What were the facts?
The Commissioner of Income Tax, Chennai (Revenue) filed two appeals (T.C.A.Nos.896 and 897 of 2017) before the High Court of Judicature at Madras. These appeals challenged an order dated 21.12.2016 passed by the Income Tax Appellate Tribunal (ITAT), "D" Bench, Chennai. The ITAT's order pertained to the assessment years 2009-10 and 2010-11 and concerned the transfer pricing matters of M/s. Durr India Private Limited (Assessee). The appeals were filed under Section 260A of the Income Tax Act, 1961.
What were the issues?
The Tribunal had to decide the following substantial questions of law: 1. Whether the Tribunal was correct in directing that disparate transactions be bundled together for benchmarking under the Transactional Net Margin Method (TNNM)? (Section 92C of the Income Tax Act, 1961) 2. Whether it was proper for the Tribunal to not consider that only closely linked transactions can be benchmarked using an integrated approach, which was not the case here? (Section 92C of the Income Tax Act, 1961) 3. Whether the Tribunal was correct in disregarding the OECD guidelines, which provide for benchmarking on a transaction-by-transaction basis and are approved for use in Indian Transfer Pricing? 4. Whether the Tribunal was correct in not taking cognizance of Para 7.6 of the OECD guidelines, which deals with intra-group services and mandates that all transactions are to be viewed separately for arriving at the Arm's Length Price (ALP)? The Revenue argued that the ITAT erred in bundling disparate transactions and disregarding the transaction-by-transaction approach advocated by OECD guidelines. The Assessee's arguments are not recorded in the provided text.
