COMMISSIONER OF INCOME TAX vs. YENTOP MANICKAM EDIBLE OILS
What did the High Court hold?
The High Court dismissed the appeal filed by the Revenue. The dismissal was based on the Revenue's submission that the appeal was not being pursued due to a low tax effect, in line with CBDT Circular No. 17/2019, which increased the monetary limit for appeals before the High Court to Rs. 1 Crore. The Court noted that the tax effect in this case was below the threshold. Consequently, the substantial questions of law framed for the appeal were left open. The Revenue was granted liberty to seek restoration of the appeal if the tax effect was found to be above the threshold limit. No costs were imposed.
What were the facts?
The Revenue, represented by the Commissioner of Income Tax, Corporate Circle-2, Madurai, filed an appeal before the High Court of Judicature at Madras against an order dated February 17, 2016, passed by the Income Tax Appellate Tribunal (ITAT), Chennai 'C' Bench. The appeal pertains to assessment year 2009-10 and challenges the ITAT's deletion of an addition made under Section 2(22)(e) of the Income Tax Act, 1961. The assessee is M/s. Yentop Manickam Edible Oils Pvt. Ltd., Virudhunagar. The High Court admitted the appeal on substantial questions of law.
What were the issues?
The Tribunal had to decide two substantial questions of law: 1. Whether, on the facts and circumstances of the case and in law, the ITAT was correct in deleting the addition made under Section 2(22)(e), which provides that payments by a private company by way of advance/loan to shareholders, or by lenders to a borrowing company where substantial common shareholding exists in both companies, attract deemed dividend provisions. 2. Whether, on the facts and circumstances of the case and in law, the ITAT was correct and justified in holding that deemed dividend can be assessed only in the hands of the shareholder of the lending company and not the person in receipt of such loan/advance. The Revenue argued that the ITAT erred in deleting the addition under Section 2(22)(e) and in its interpretation of who the deemed dividend should be assessed against. The judgment does not record specific arguments from the assessee on these points.
