COMMISSIONER OF INCOME TAX vs. G.HARIKRISHNAN
What did the High Court hold?
The High Court dismissed the appeal on account of low tax effect, citing CBDT Circular No.17/2019 which increased the monetary limit for pursuing appeals before the High Court to Rs.1 Crore. The Revenue submitted that the tax effect in this case was below this threshold. Consequently, the substantial questions of law were left open. The Court granted liberty to the Revenue to seek restoration of the appeal if the tax effect was found to be above the threshold limit, for a decision on merits. The specific findings of the Tribunal on the taxability of profit on sale of land and the criteria for determining agricultural land were not adjudicated upon by the High Court.
What were the facts?
The Revenue, Commissioner of Income Tax, Business Ward XIII(3), Chennai, filed an appeal under Section 260A of the Income Tax Act, 1961, against an order dated 22.7.2016 passed by the Income Tax Appellate Tribunal (ITAT), Chennai 'C' Bench. The appeal pertains to assessment year 2007-08. The ITAT's order was challenged regarding the taxability of profit on sale of land. The assessee is Shri G. Harikrishnan. The High Court admitted the appeal on substantial questions of law on 11.1.2017. The Revenue was represented by counsel, while the assessee was served but did not appear.
What were the issues?
The High Court had to decide two substantial questions of law: 1. Whether, on the facts and circumstances of the case and in law, the Tribunal was right and justified in holding that profit on sale of land is not eligible for taxation under the head 'capital gains' although the land was sold within a short span of one year and the assessee did not do any agricultural operations on such land? 2. Whether, on the facts and circumstances of the case and in law, the Tribunal was right and justified in holding that the criteria to determine whether a land is agricultural or not is the classification in village records and not its actual use and whether such decision is contrary to the binding principle laid down by the Apex Court in CWT Vs. Officer in Charge (Court of Wards) [(1976) 105 ITR 133] and Sarifabibi Mohammed Ibrahim & Others Vs. CIT [204 ITR 631 (SC)]? The Revenue argued that the profit on sale of land should be taxed as capital gains, questioning the Tribunal's finding that it was not eligible for taxation, especially given the short holding period and lack of agricultural operations. The Revenue also contended that the Tribunal erred in holding that village record classification, rather than actual use, determines agricultural status, citing Supreme Court precedents. The judgment records no arguments for the assessee.
