HARI PODDAR vs. THe ASST COMMISSIONER OF
What did the High Court hold?
The High Court did not decide the substantial questions of law. It was informed by the learned counsel for the appellant (assessee) that the assessee had been issued with Form-3 under the Direct Tax Vivad Se Vishwas Act, 2020. Consequently, the assessee sought permission to withdraw the appeals. In light of this submission, the High Court dismissed the Tax Case Appeals as withdrawn. No costs were imposed, and the connected miscellaneous petitions were closed. The court did not make any findings on the merits of the substantial questions of law raised by the assessee.
What were the facts?
The appeals were filed by the assessee, Hari Poddar, against the order of the Income Tax Appellate Tribunal (ITAT), Chennai 'A' Bench, dated 24.05.2017. The ITAT's order pertained to block assessment years 1997-98 to 2003-04 (up to 08.08.2002). The assessee challenged the ITAT's findings on various grounds, including the timeliness of the block assessment order, the validity of panchanamas, the sustainment of additions for undisclosed turnover, unexplained cash credits, and unaccounted purchases. The appeals were filed under Section 260A of the Income Tax Act, 1961. The High Court of Judicature at Madras was hearing these appeals.
What were the issues?
The High Court was to decide several substantial questions of law. The primary issues revolved around: 1. Whether the block assessment order dated 21.10.2004 was within the time limit prescribed by Explanation 2 to Section 158BE(1)(b) of the Income Tax Act, 1961, considering the date of the last panchanama (assessee argued it was 08.08.2002, not 03.10.2002). 2. Whether the ITAT erred in applying the judgment in VLS Finance Ltd. Vs CIT. 3. Whether the block assessment was barred by limitation due to the absence of a subsequent search and only subsequent panchanamas being prepared. 4. Whether the panchanama drawn on 01.10.2002 (or 03.10.2002 for Hari Poddar) was to be treated as the last panchanama for determining the limitation period. 5. Whether the ITAT correctly upheld the block assessment without deciding on the legality of the conclusion of the search with reference to the panchanama dated 03.10.2002. 6. Whether the ITAT was right in sustaining additions for undisclosed turnover and unexplained cash credits/unaccounted purchases in the absence of incriminating material from the search. 7. Whether the entire unexplained credit should be considered income under Section 68, without estimation of GP. The assessee contended that the assessment order was time-barred, the ITAT's reliance on VLS Finance was misplaced, and additions were made without supporting evidence. The revenue's arguments are not explicitly detailed in the provided text.
