What did the High Court hold?

The High Court dismissed the appeal as withdrawn. The dismissal was based on the submission by the Revenue that the tax effect in the appeal was less than the monetary limit prescribed by CBDT Circular No. 17/2019. The Circular mandates that appeals shall not be filed or pursued by the Department before the High Court if the tax effect does not exceed Rs. 1,00,00,000/-. The Court noted that the substantial question of law, which was whether rent received from employees for dwelling units should be treated as business income or income from other sources, was kept open for determination in an appropriate case. No costs were awarded.

What were the facts?

The Revenue, Commissioner of Income Tax, filed an appeal under Section 260A of the Income Tax Act, 1961, against an order dated 05.06.2012 passed by the Income Tax Appellate Tribunal (ITAT), Chennai. The appeal pertained to assessment year 2006-07 and concerned the treatment of rent received by the assessee, M/s. Pentamedia Graphics Ltd., from its employees for dwelling units. The High Court admitted the appeal on a substantial question of law on 24.11.2015. Subsequently, the Revenue brought to the court's notice CBDT Circular No. 17/2019, which stipulates that appeals shall not be filed or pursued if the tax effect does not exceed Rs. 1,00,00,000/-. The Revenue submitted that the tax effect in this case was below this threshold.

What were the issues?

1. Whether the Tribunal was right in treating the rent received by the assessee from its employee against the allotment of dwelling units as business income and not as income from other sources? (Question of law) Assessee's contentions: Not recorded in the judgment. Revenue's contentions: The Revenue argued that the appeal should be dismissed as withdrawn in light of CBDT Circular No. 17/2019, stating that the tax effect in this appeal is less than the stipulated threshold limit of Rs. 1,00,00,000/-. The Revenue relied on this circular to justify not pursuing the appeal.
