COMMISSIONER OF INCOME TAX vs. C. SRIKANTH
What did the High Court hold?
The High Court, in light of the submission by the Revenue regarding CBDT Circular No.17/2019, which stipulates that appeals shall not be filed or pursued if the tax effect does not exceed Rs.1,00,00,000/-, noted that the tax effect in the present appeals was less than the threshold limit. Consequently, the Court dismissed the appeals as withdrawn. The substantial questions of law were kept open for determination in appropriate cases. No costs were awarded, and connected miscellaneous petitions were closed. The Tribunal's decision on the classification of income from share transactions as short-term capital gains or business income was not adjudicated upon by the High Court due to the withdrawal of the appeals.
What were the facts?
The appeals were filed by the Commissioner of Income Tax, Chennai (appellant/Revenue) against the common order dated 25.02.2015 passed by the Income Tax Appellate Tribunal, 'B' Bench, Chennai. The appeals concerned assessment years 2005-06 and 2006-07. The appeals were admitted by the High Court on substantial questions of law. During the hearing, the Revenue brought to the court's notice CBDT Circular No.17/2019, which stipulates that appeals shall not be filed or pursued if the tax effect does not exceed Rs.1,00,00,000/-. The Revenue submitted that the tax effect in these appeals was below this threshold limit.
What were the issues?
1. Whether, on the facts and circumstances of the case, the Tribunal was right in holding that the income from share transaction is liable to be taxed under the head “short term capital gains” and not as business income? (Question of law) 2. Whether the fact finding of the Tribunal is proper by treating the income under the head short term capital gains ignoring the frequency of the transaction and the short duration of period of holding which would go to establish that the same was liable to be taxed under the head business income and not for earning dividend? (Question of mixed law and fact) Assessee's Contentions: Not recorded in the judgment. Revenue's Contentions: The Revenue argued that the Tribunal erred in treating the income from share transactions as short-term capital gains instead of business income. They contended that the frequency and short duration of holding the shares indicated that the income should be taxed as business income. The Revenue relied on CBDT Circular No.17/2019, stating that the tax effect in these appeals was below the prescribed monetary limit for pursuing appeals.
