COMMISSIONER OF INCOME TAX vs. SRI P.SELVARAJ
What did the High Court hold?
The High Court dismissed the Tax Case Appeals on the ground of tax effect, citing CBDT Circular No. 17/2019 dated August 8, 2019. The circular stipulates that appeals before the High Court should have a monetary limit of Rs. 1 crore. Since the tax effect in these appeals was less than this limit, the appeals were dismissed. However, the substantial questions of law framed were left open. The Revenue was granted liberty to mention the case before the court to restore the appeals for hearing and decision on merits if the tax effect is found to be above the prescribed limit. No costs were imposed, and connected miscellaneous petitions were also closed.
What were the facts?
The Revenue filed these appeals under Section 260A of the Income Tax Act, 1961, against the order of the Income Tax Appellate Tribunal (ITAT) dated August 3, 2012. The ITAT had dismissed the appeals filed by the Revenue against the orders of the Commissioner of Income Tax (Appeals) [CIT(A)] for assessment years 2002-03 to 2008-09. The appeals before the High Court were admitted on substantial questions of law. However, the Revenue's counsel submitted that the tax effect in these cases was less than Rs. 1 crore, which is the monetary limit for filing appeals before the High Court as per CBDT Circular No. 17/2019 dated August 8, 2019. The High Court considered this submission and the circular.
What were the issues?
1. Whether, on the facts and in the circumstances of the case, the Appellate Tribunal was right in not giving the Assessing Officer an opportunity to verify the details of deposits in bank accounts/peak credits, unexplained investment on purchase of properties, and unaccounted cheques/pro-notes, which were produced before the CIT(A), and if this action is against Rule 46A of the Income Tax Rules, 1962? 2. Whether, on the facts and in the circumstances of the case, the Appellate Tribunal was right in granting relief towards unaccounted advance to a third party and unexplained credit from agricultural income, which were claimed before the CIT(A)? 3. Whether, on the facts and in the circumstances of the case, the Appellate Tribunal was right in simply upholding the order of the CIT(A) without considering the grounds of appeal raised by the Department before the Tribunal? Assessee's arguments: Not recorded in the judgment. Revenue's arguments: The tax effect in these cases is less than Rs. 1 crore and is covered by CBDT Circular No. 17/2019 dated August 8, 2019, which fixes the monetary limit for filing appeals before the High Court at Rs. 1 crore. Therefore, these appeals should be dismissed.
