What did the High Court hold?

The High Court did not decide the substantial question of law framed for consideration due to subsequent developments. The enactment of the Direct Tax Vivad Se Vishwas Act, 2020, provided a mechanism for the resolution of disputed tax. The assessee informed the Court that they had been issued Form-3 under this Act on 23.02.2021 and sought permission to withdraw the appeal. Consequently, the Court dismissed the Tax Case Appeal as withdrawn. No costs were awarded. The operative direction was to dismiss the appeal as withdrawn.

What were the facts?

The assessee, The India Cements Educational Society, filed an appeal before the High Court of Judicature at Madras against an order dated 20.01.2016 passed by the Income Tax Appellate Tribunal, Madras "C" Bench, in I.T.A.No.1525/Mds/2010 for the assessment year 2007-08. The appeal was admitted on a substantial question of law. Subsequently, the Direct Tax Vivad Se Vishwas Act, 2020, was enacted. The assessee was issued Form-3 under this Act on 23.02.2021 and sought permission to withdraw the appeal.

What were the issues?

1. Whether the Tribunal ought to have held that non-investment of sale consideration in an approved mode is a violation of Section 11(1A) and not a violation of Section 13(1)(c) of the Income Tax Act, 1961, and hence the capital gains is taxable under Section 112? Assessee's contention: The assessee argued that the non-investment of sale consideration in an approved mode constitutes a violation of Section 11(1A) and not Section 13(1)(c) of the Act, implying that capital gains should be taxable under Section 112. The judgment does not record any specific arguments from the revenue.
