THE COMMISSIONER OF INCOME vs. M/S. BIOMED HITECH INDUSTRIES
What did the High Court hold?
The High Court dismissed the appeal filed by the Revenue on account of low tax effect, as submitted by the Revenue's counsel. The Court noted that the monetary limit for filing or pursuing an appeal before the High Court had been increased to Rs.1 Crore by CBDT Circular No.17/2019, and the tax effect in this case was less than the threshold. The substantial questions of law framed for the appeal were left open. The Court granted liberty to the Revenue to mention the case for restoration if the tax effect was found to be above the fixed threshold, to be heard and decided on merits. No costs were imposed.
What were the facts?
The Revenue, Commissioner of Income Tax, Chennai, filed an appeal under Section 260A of the Income Tax Act, 1961, against an order dated 25.5.2016 passed by the Income Tax Appellate Tribunal, Chennai 'D' Bench. The appeal pertains to the assessment year 2007-08 and challenges the Tribunal's decision regarding the disallowance of CENVAT credit. The appeal was admitted on 29.11.2016 on substantial questions of law. The Revenue later submitted that it was not pursuing the appeal due to low tax effect, citing CBDT Circular No.17/2019 which increased the monetary limit for appeals to the High Court to Rs.1 Crore. The tax effect in this case was stated to be below this threshold.
What were the issues?
1. Whether, on the facts and circumstances of the case, the Tribunal was right in holding that the disallowance of claim of CENVAT credit is not a mistake apparent from record which could be rectified under Section 154? 2. Is not the finding of the Tribunal bad by holding that rectification under Section 154 is not proper especially when disallowing the claim of CENVAT credit has no bearing on revenue recognized and the expenditure claimed does not relate to the relevant year and therefore, would be a patently inadmissible expenditure? Assessee's arguments: The judgment does not record any specific arguments made by the assessee, M/s.Biomed Hitech Industries Ltd. Revenue's arguments: The Revenue submitted that the appeal was not being pursued due to low tax effect, as per CBDT Circular No.17/2019, which increased the monetary limit for High Court appeals to Rs.1 Crore. The tax effect in this case was below the threshold.
