COMMISSIONER OF INCOME TAX vs. TALLBOY STATIONERY PVT LTD
What did the High Court hold?
The High Court did not decide the substantial questions of law on merits. The learned counsel for the appellant/Revenue brought to the notice of the Court Circular No.17/2019 dated 08.08.2019 issued by the Central Board of Direct Taxes. This circular stipulates that appeals shall not be filed or pursued by the Department before the High Court if the tax effect does not exceed Rs. 1,00,00,000/-. The Revenue submitted that the tax effect in the present appeal was less than this threshold limit. Consequently, the High Court dismissed the appeal as withdrawn, stating that the substantial questions of law were kept open for determination in an appropriate case. No costs were awarded.
What were the facts?
The Revenue, Commissioner of Income Tax, Corporate Circle - 3 (1), Chennai, filed an appeal under Section 260A of the Income Tax Act, 1961, against the order dated 13.04.2016 passed by the Income Tax Appellate Tribunal, “A” Bench, Chennai. The appeal pertained to assessment year 2006-07 and concerned an addition made by the Assessing Officer in the hands of the assessee, M/s. Tallboy Stationery Private Limited. The dispute involved the interpretation and application of Section 2(22)(e) of the Income Tax Act, 1961, concerning loans or advances received by the assessee from M/s. Chennai Micro Prints Private Limited. The High Court was seized of the matter.
What were the issues?
The Tribunal had to decide the following substantial questions of law: 1. Whether the Tribunal was correct in deleting the addition made by the Assessing Officer under Section 2(22)(e) in the hands of the assessee company? 2. Whether the Tribunal was correct in holding that the addition could not be made in the hands of the assessee as it was not a registered shareholder of M/s. Chennai Micro Prints Private Limited from which it received a loan/advance? 3. Whether the Tribunal correctly interpreted Section 2(22)(e) in light of Circular No. 495 dated 22.09.1987? Assessee's contentions: The judgment does not record specific arguments made by the assessee. However, the questions of law framed by the Revenue imply that the assessee likely argued against the addition made under Section 2(22)(e) and contended that the conditions for its application were not met, particularly regarding shareholding status. Revenue's contentions: The Revenue contended that the Tribunal erred in deleting the addition made under Section 2(22)(e) and that the Tribunal's interpretation of the section and its application in light of the circular were incorrect.
