COMMISSIONER OF INCOME TAX vs. M/S.EDEN EXPORTS COMPANY
What did the High Court hold?
The High Court of Judicature at Madras, in its judgment delivered by R. Mahadevan, J., noted that the Revenue had brought to its attention CBDT Circular No. 17/2019. This circular mandates that appeals shall not be filed or pursued by the Department before the High Court if the tax effect does not exceed Rs. 1,00,00,000/-. The Revenue submitted that the tax effect in the present appeal was less than this stipulated threshold limit. In light of this submission, the Court dismissed the appeal as withdrawn. The substantial questions of law were kept open for determination in an appropriate case. No costs were awarded.
What were the facts?
The Revenue, represented by the Commissioner of Income Tax, filed a Tax Case Appeal before the High Court of Judicature at Madras, challenging an order dated 30.12.2015 passed by the Income Tax Appellate Tribunal (ITAT), 'A' Bench, Chennai. This order pertained to the assessment year 2007-08 and concerned M/s. Eden Exports Company. The appeal was admitted by the High Court on substantial questions of law. Subsequently, the Revenue brought to the court's notice CBDT Circular No. 17/2019, which stipulates that appeals should not be filed or pursued if the tax effect does not exceed Rs. 1,00,00,000/-. The Revenue submitted that the tax effect in this particular appeal was below this threshold.
What were the issues?
1. Whether on the facts and in the circumstances of the case, the Tribunal was right in law in holding that the provisions of Section 40(a)(ia) of the Income Tax Act are applicable only to the amounts of expenditure which are payable as on 31st March of the relevant previous year and it cannot be invoked to disallow expenditure which had been actually paid during the previous year, without deduction of tax at source? 2. Whether on the facts and circumstances of the case, the Hon'ble Income Tax Appellate Tribunal was right in not applying the decision of Hon'ble Gujarat High Court in the case of Sikandarkhan N Tunvar reported in 33 Taxman.com 133 and Hon'ble Calcutta High Court in the case of Crescent Export Syndicate reported in 33 Taxman.com 256 wherein it was held that such a disallowance can be made even qua the sum already paid and not only those remain payable? Assessee's contentions: Not recorded in the judgment. Revenue's contentions: The Revenue argued that the ITAT's decision was incorrect and that disallowance under Section 40(a)(ia) could be made even for amounts already paid, not just those remaining payable. The Revenue relied on the decisions of the Gujarat High Court in Sikandarkhan N Tunvar and the Calcutta High Court in Crescent Export Syndicate.
