INDUS FINANCE LTD vs. THEDEPUTY COMMISSIONER OF IN
What did the High Court hold?
The High Court disposed of the appeal in light of the subsequent event of the assessee filing a declaration under the Vivad Se Vishwas Scheme. The Court directed the Competent Authority to process the application under the Direct Tax Vivad Se Vishwas Act, 2020, and pass appropriate orders expeditiously. The assessee was granted liberty to restore the appeal if the decision on their declaration was not in their favour. Consequently, the substantial questions of law framed for the appeal were left undecided. No costs were awarded. The judgment does not provide findings on the merits of the substantial questions of law.
What were the facts?
The assessee, M/s.Indus Finance Ltd., filed an appeal before the High Court of Judicature at Madras against an order dated 03.05.2018 passed by the Income Tax Appellate Tribunal, Chennai. The appeal pertains to the assessment year 2012-13. The High Court admitted the appeal on substantial questions of law. Subsequently, the assessee informed the Court that they had filed a declaration/undertaking under the Vivad Se Vishwas Scheme on 30.01.2021 and were awaiting orders. The Court noted this subsequent event and directed the Competent Authority to process the application under the Direct Tax Vivad Se Vishwas Act, 2020.
What were the issues?
The High Court admitted the appeal on five substantial questions of law: 1. Whether annual accounts/financial statements adopted under the Companies Act, 1956, can be altered/adjusted for additions under the book profits regime (Section 115JB) beyond permitted adjustments by the Assessing Officer. 2. Whether disclosure for charging higher depreciation for book purposes under the Companies Act, 1956, is adequate, considering the management's perspective of charging higher depreciation based on asset performance. 3. Whether additional conditions on disclosure in a circular can override the prescription for preparing financial statements as per Section 205 read with Schedule XIV of the Companies Act, 1956. 4. Whether the Appellate Tribunal was correct in approving the addition of excess depreciation under Section 115JB, despite accepting the assessee's right under the Companies Act, 1956, to charge different depreciation rates for financial statements. 5. Whether the interpretation of Section 43B(d) is correct in the context of interest payable on loans secured by key-man insurance policies, for considering the deduction claimed, when such interest charge could fall under Section 37(1). The assessee's contentions were not explicitly detailed in the provided text, but the questions themselves indicate the nature of their arguments regarding the interpretation and application of company law provisions and income tax provisions, particularly concerning book profits and depreciation. The revenue's contentions were not recorded.
