What did the High Court hold?

The High Court dismissed the appeals filed by the Revenue. The dismissal was based on the submission by the Revenue that the appeals were not being pursued due to low tax effect, as per CBDT Circular No. 17/2019, which raised the monetary threshold for appeals to the High Court to Rs. 1 Crore. The Court noted that the tax effect in these cases was below the specified limit. Consequently, the substantial questions of law framed were left open. The Revenue was granted liberty to seek restoration of the appeals if the tax effect was found to be above the threshold limit. No costs were imposed. The connected Civil Miscellaneous Petitions were also dismissed.

What were the facts?

The appeals were filed by the Revenue against the common order of the Income Tax Appellate Tribunal (ITAT) dated February 19, 2016, concerning assessment years 2004-05, 2005-06, and 2008-09. The assessee is M/s. AVT McCormick Ingredients Ltd., Chennai. The appeals were admitted by the High Court on November 14, 2016, on specific substantial questions of law. The Revenue, represented by learned Senior Standing Counsel, submitted that the appeals were not being pursued due to low tax effect, citing CBDT Circular No. 17/2019 which increased the monetary limit for appeals to the High Court to Rs. 1 Crore. The tax effect in these cases was stated to be below this threshold.

What were the issues?

The Tribunal had to decide two substantial questions of law: 1. Whether, on the facts and in the circumstances of the case, the Tribunal was right in holding that the RBI approval of the royalty rate itself implies that the payment of royalty is at arms' length price? 2. Whether the reasoning and finding of the Tribunal is proper especially when the Transfer Pricing Officer has mentioned under Section 92CA(3) in a control transaction involved with Associate Enterprise and had arrived at an upward adjustment on account of price variation of product computed under comparable uncontrolled price method? The Revenue argued that the appeals were not being pursued due to low tax effect, citing CBDT Circular No. 17/2019. The assessee's contentions are not recorded in the judgment. The judgment does not record any arguments from the assessee on the merits of the case.
