THE COMMISSIONER OF INCOME T vs. M/S. CHOLAMANDALAM MS
What did the High Court hold?
The High Court noted that the Revenue had brought to its attention CBDT Circular No. 17/2019, which mandates that appeals shall not be filed or pursued by the Department before the High Court if the tax effect does not exceed Rs. 1,00,00,000/-. The Revenue further submitted that the tax effect in the present appeal was less than this stipulated threshold limit. In light of this submission by the Revenue, the High Court considered the appeal to be dismissed as withdrawn. The substantial questions of law were kept open for determination in an appropriate case. No costs were awarded.
What were the facts?
The Commissioner of Income Tax, Chennai (Revenue) filed a Tax Case Appeal under Section 260A of the Income Tax Act, 1961, against an order dated 28.01.2016 passed by the Income Tax Appellate Tribunal (ITAT), 'A' Bench, Chennai. The appeal pertained to assessment year 2003-04 and concerned M/s. Cholamandalam MS General Insurance Co. Ltd. (Assessee). The High Court admitted the appeal on substantial questions of law. Subsequently, during the hearing, the Revenue brought to the court's notice CBDT Circular No. 17/2019, which stipulates that appeals shall not be filed or pursued if the tax effect does not exceed Rs. 1,00,00,000/-. The Revenue submitted that the tax effect in this appeal was below this threshold.
What were the issues?
The substantial questions of law before the High Court were: 1. Whether the Tribunal was right in granting depreciation on the composite value of a flat, which included the cost of land. 2. Whether the Tribunal's finding was bad in law by directing the Assessing Officer not to bifurcate the cost of land from the building cost, which is contrary to the Apex Court's judgment in Hoogly Mills (287 ITR 333). 3. Whether the Tribunal's order directing the Assessing Officer to allow depreciation on the land cost was proper, given that depreciation cannot be allowed on land. Contentions: Assessee: Not recorded in the judgment. Revenue: The tax effect in the appeal is less than the threshold limit specified in CBDT Circular No. 17/2019, and therefore, the appeal should not be pursued.
