What did the High Court hold?

The High Court noted that the learned counsel for the appellant (assessee) had drawn attention to a memo filed on 15.10.2020, stating instructions to seek withdrawal of the tax case appeals. The Court placed the memo on record and consequently dismissed the appeals as withdrawn. The substantial questions of law were left open. No decision was made on the merits of the disallowance of sub-contractor payments or the interpretation of Section 40(a)(i) and Section 194C. The connected miscellaneous petition was also closed. No costs were awarded.

What were the facts?

The assessee, M/s Edac Engineering Limited, filed two Tax Case Appeals (TCA.Nos.740 and 741 of 2019) before the High Court of Judicature at Madras. These appeals were directed against the order of the Income Tax Appellate Tribunal (ITAT), 'D' Bench, Chennai, dated 10.06.2013, concerning Assessment Year 2008-2009. The appeals were filed under Section 260A of the Income Tax Act, 1961. The respondent in these appeals was the Assistant Commissioner of Income Tax, Company Circle - V (1). The appeals challenged the ITAT's decision regarding disallowance of sub-contractor payments due to non-deduction of TDS.

What were the issues?

The Tribunal had to decide the following substantial questions of law: 1. Whether the Appellate Tribunal erred in law by accepting the revenue's plea on the applicability of Section 40(a)(i) of the Income Tax Act, 1961, for disallowing sub-contractor payments without appreciating the distinction between 'paid' and 'payable', and whether Section 40(a)(i) applies to outstanding sums without TDS or actual payments. 2. Whether the Appellate Tribunal erred in law by concluding the applicability of Section 40(a)(i) to sub-contractor payments without TDS, even when Section 194C of the Act was factually not applicable. 3. Whether the Appellate Tribunal erred in law by restricting the scope of the appeal before the CIT (Appeals) when restoring the matter, considering the evolution of judicial precedents on Section 40(A)(i). The assessee argued that Section 40(a)(i) should not be attracted to actual payments but only to sums remaining outstanding without TDS, and that Section 194C was factually not applicable. The revenue contended for the applicability of Section 40(a)(i) to disallow the payments. The judgment does not record specific arguments from either side regarding the third question.

Which sections of the Income-tax Act were involved?

Section 40(a)(i),Section 194C,Section 260A

The assessee has raised the following Substantial Questions of Law for consideration: “1. Whether the Appellate Tribunal is correct in law in accepting the plea of the respondent on the applicability of Section 40 (a) (i) of the Act for making the disallowance of the claim of sub contractor's payments in the computation of taxable total income without appreciating the distinction of the term 'paid' and 'payable' inasmuch as the provisions of section 40(a)(i) of the Act would get attracted to the sum remaining outstanding in the books of the appellant, shown as payable without TDS as per section 194C of the Act and not to the actual payments? 2/5 http://www.judis.nic.in TCA.Nos.740 and 741 of 2019 2. Whether the Appellate Tribunal is correct in Law in concluding the applicability of section 40(a)(i) of the act to the sub-contractor's payments without TDS even though the provisions governing section 194C of the Act had no application to such payments on the factual matrix of the case? 3. Whether the Appellate Tribunal is correct in Law in restricting the scope of the appeal before the CIT (Appeals) while rendering decision in restoring the matter back to his file even though the interpretation of section 40(A)(i) of the Act was continuously evolved by various judicial precedents subsequently? 3. We have heard Mr.A.S.Sriraman, learned counsel for the appellant / assessee and Ms.R.Hemalatha, learned senior standing counsel for the respondent / assessee. 4.
