M/S. RAMANAIDU CHARITABLE vs. THE INCOME TAX OFFICER
What did the High Court hold?
The High Court disposed of the appeals without deciding the substantial questions of law. The Court noted that the assessee had filed a declaration/undertaking under the Vivad Se Vishwas Act, 2020. Consequently, the Competent Authority was directed to process the application/declaration under the Act and pass appropriate orders expeditiously. The assessee was granted liberty to restore the appeals if the ultimate decision on their declaration was not in their favour. If such a prayer was made, the Registry was to entertain it without insisting on a delay condonation application. The substantial questions of law were expressly left undecided.
What were the facts?
The assessee, M/s.Ramanaidu Charitable Trust, filed six appeals (TCA.Nos.74 to 79 of 2018) before the High Court of Judicature at Madras, challenging a common order dated 28.04.2017 passed by the Income Tax Appellate Tribunal (ITAT), 'C' Bench, Chennai. These appeals pertained to assessment years 2005-06 to 2010-11. The appeals were filed under Section 260A of the Income Tax Act, 1961, against the ITAT's decision. The Revenue was represented by the Income Tax Officer (Exemptions), Ward-4. The High Court heard arguments from both sides and noted a subsequent development.
What were the issues?
The Tribunal had to decide five substantial questions of law raised by the assessee: 1. Whether the Tribunal erred in holding that the Appellant Trust is not entitled to the benefit under Section 11, despite no undue benefit to a person referred to in Section 13(3). 2. Whether the Tribunal erred in denying the benefit when there was no violation of Section 13 and the entire cost of film production was eligible for deduction by the donor under Rule 9. 3. Whether the Tribunal was correct in holding that the amendment to Section 2(15) was not applicable to assessment years 2005-06 to 2010-11, despite the amendment being effective from 01.04.2009. 4. Whether the Tribunal erred in denying the benefit under the proviso to Section 2(15) when this proviso was not invoked during assessment proceedings. 5. Whether the Tribunal was correct in holding that re-opening of assessment under Section 148 was valid for assessment years 2005-06 to 2010-11 without intimation under Section 143(1), and whether re-opening under Section 148 could be based on a mere change of opinion without new material facts. Assessee's Contention: The assessee argued that they had filed a declaration/undertaking under the Vivad Se Vishwas Scheme and were awaiting orders. The Revenue's Contention: The judgment does not record specific contentions made by the Revenue on the substantial questions of law.
