COMMISSIONER OF INCOME TAX - vs. SHRI. D. AMIRTARAJ
What did the High Court hold?
The High Court dismissed the Tax Case Appeal filed by the Revenue on the grounds of low tax effect, citing Circular No.17/2019 dated 08.08.2019. The circular stipulates a monetary limit of Rs.1 crore for filing appeals before the High Court. As the tax effect in this case was less than Rs.1 crore, the appeal was dismissed. However, the Court explicitly stated that the substantial questions of law framed were left open. Liberty was granted to the Revenue to seek restoration of the appeal if the tax effect is found to be above the prescribed limit, to be heard and decided on merits. No costs were awarded. The judgment did not decide the substantial questions of law on their merits.
What were the facts?
The Revenue (Commissioner of Income Tax – I, Coimbatore) filed a Tax Case Appeal before the High Court of Judicature at Madras against an order dated 25.02.2014 passed by the Income Tax Appellate Tribunal (ITAT), Chennai 'B' Bench. The ITAT had allowed an appeal filed by the Assessee (D. Amirtaraj) against the order of the CIT(A)-I, Coimbatore, dated 02.11.2012, for the assessment year 2009-10. The Assessee's appeal before the ITAT concerned the classification of income derived from the purchase and sale of lands. The present appeal by the Revenue challenges the ITAT's decision.
What were the issues?
1. Whether, on the facts and in the circumstances of the case, the Appellate Tribunal was right in law in holding that the assessee was not carrying on a business or an adventure in the nature of trade, when the assessee purchased and sold certain lands with business motive? (Question of law) 2. Whether, on the facts and in the circumstances of the case, the Appellate Tribunal was right in law in holding that the lands in question are agricultural lands without considering any evidence produced by the assessee before it? (Question of law) 3. Whether, on the facts and in the circumstances of the case, the Appellate Tribunal was right in holding that the co-owner of the property for the very same assessment year the transaction has not been held as business income, without verifying that the department has reopened co-owner's assessment, for the assessment year 2009-10 by issuing notice u/s.148 dated 29.04.2013 itself to assess the income as business income? (Question of mixed law and fact) Contentions: Assessee: Not recorded in the judgment. Revenue: The tax effect in this case is less than Rs.1 crore and is covered by Circular No.17/2019 dated 08.08.2019 issued by the CBDT, which fixes the monetary limit for filing an appeal before the High Court at Rs.1 crore. Therefore, the appeal should be dismissed.
