COMMISSIONER OF INCOME TAX vs. M/S.MAGNA ELECTRO CASTINGS L
What did the High Court hold?
The High Court dismissed the appeal filed by the Revenue on the grounds of low tax effect, as per CBDT Circular No. 17/2019. The Court noted the submission by the Revenue that the tax effect was less than the increased threshold limit for pursuing appeals before the High Court. Consequently, the substantial question of law framed for consideration was left open. The Court granted liberty to the Revenue to seek restoration of the appeal if the tax effect was found to be above the threshold limit, allowing it to be heard and decided on merits. No decision was made on the merits of the substantial question of law.
What were the facts?
The Revenue, Commissioner of Income Tax, Coimbatore, filed an appeal under Section 260A of the Income Tax Act, 1961, against an order dated 16.10.2014 passed by the Income Tax Appellate Tribunal (ITAT), Chennai 'D' Bench. The appeal pertained to assessment year 2009-10 and concerned the allowability of notional loss on foreign currency loans raised for asset purchase, arising from foreign exchange rate fluctuations as of the balance sheet date. The assessee, M/s. Magna Electro Castings Ltd., Coimbatore, was served but did not appear before the High Court. The appeal was admitted on a substantial question of law.
What were the issues?
1. Whether, on the facts and circumstances of the case, the Income Tax Appellate Tribunal is right in law in holding that the notional loss on foreign currency loans raised for purchase of assets arising as a result of change in the rate of foreign exchange as on the balance sheet date, is allowable as a revenue expenditure? The Revenue argued that the appeal was not being pursued due to low tax effect, citing CBDT Circular No. 17/2019 which increased the monetary limit for appeals to the High Court to Rs. 1 Crore. The Revenue stated that the tax effect in this case was below this threshold. The judgment does not record any arguments from the assessee.
