THE COMMISSIONER OF INCOME vs. M/S.DAS NETWORKS LIMITED
What did the High Court hold?
The High Court did not decide the substantial questions of law on merits. The learned counsel for the Revenue brought to the court's notice CBDT Circular No. 17/2019 dated 08.08.2019, which stipulates that appeals shall not be filed or pursued by the Department before the High Court if the tax effect does not exceed Rs. 1,00,00,000/-. It was submitted that the tax effect in these appeals was less than this threshold limit. Consequently, the appeals were dismissed as withdrawn, with the substantial questions of law being kept open for determination in appropriate cases. No costs were awarded.
What were the facts?
The Revenue, Commissioner of Income-Tax, Chennai, filed two Tax Case Appeals (TCA.Nos.71 and 72 of 2017) before the High Court of Judicature at Madras. These appeals challenged the order dated 23.06.2016 passed by the Income Tax Appellate Tribunal (ITAT) “C” Bench, Chennai, concerning assessment years 2008-09 and 2009-10. The appeals were admitted on substantial questions of law on 14.02.2017. The respondent in these appeals is M/s. Das Networks Limited.
What were the issues?
The High Court was to decide the following substantial questions of law: 1. Whether the Tribunal was justified in holding that deemed dividend could be assessed only in the hands of the shareholder in the lending company and not on the person who received such loan or advances? 2. Is the Tribunal's finding incorrect, given that Section 2(22)(e) of the Income Tax Act, 1961, specifically includes loans or advances made 'to any concern in which such shareholder is a member or a partner and in which he has substantial interest'? The Revenue argued that the Tribunal's finding was incorrect based on the wording of Section 2(22)(e). The judgment does not record specific arguments from the assessee.
