COMMISSIONER OF INCOME TAX vs. SHRI KUSHAL CHAND
What did the High Court hold?
The High Court dismissed the appeal filed by the Revenue. The dismissal was based on the submission made by the Revenue's counsel that the appeal was not being pursued due to a low tax effect, falling below the monetary threshold stipulated in CBDT Circular No.17/2019. The Court noted that the substantial questions of law framed by the Revenue were left open. Liberty was granted to the Revenue to file a petition to restore the appeal if the tax effect was found to be above the threshold limit, for a decision on merits. No costs were imposed. The specific findings of the ITAT on the issues of Section 50C and the DVO report were not adjudicated upon by the High Court.
What were the facts?
The Revenue, Commissioner of Income Tax, Non-Corporate Ward 9(2), Chennai, filed an appeal under Section 260A of the Income Tax Act, 1961, against an order dated 28.08.2018 passed by the Income Tax Appellate Tribunal, Madras 'D' Bench. The appeal pertained to assessment year 2013-14 and concerned the assessee, Shri Kushal Chand. The Revenue's appeal was based on substantial questions of law related to the applicability of Section 50C and the consideration of a Director of Valuation Officer's (DVO) report. However, the Revenue later submitted that the appeal was not being pursued due to low tax effect, as per CBDT Circular No.17/2019, which increased the monetary limit for appeals to the High Court to Rs.1 Crore.
What were the issues?
1. Whether on the facts and circumstances of the case, the Hon'ble ITAT erred in law in holding that the reference to Sec 50C was not warranted in this case, as reference to DVO is mandatory as per provisions of Sec 50C of the IT Act? 2. Whether on the facts and circumstances and in law, the ITAT is correct in not taking into account the report of the DVO to whom it is referred at the request of the assessee as per the provisions of Sec 50C of the Act? Revenue's Contention: The Revenue argued that the ITAT erred in its findings regarding Section 50C and the mandatory nature of a DVO reference, and in not considering the DVO's report. The Revenue later submitted that the appeal was not being pursued due to low tax effect, citing CBDT Circular No.17/2019. Assessee's Contention: The judgment records no specific contentions from the assessee regarding the merits of the case. The assessee's counsel appeared, but the appeal was dismissed on the Revenue's submission regarding low tax effect.
