What did the High Court hold?

The High Court did not decide the substantial questions of law framed for consideration. The court noted that the Direct Tax Vivad Se Vishwas Act, 2020, had been enacted to provide for the resolution of disputed tax. The learned counsel for the appellant (assessee) informed the court that the assessee had filed the requisite forms under Section 4 of the Vivad Se Vishwas Act, and the department had issued Form-3. In view of this submission, the learned counsel for the appellant sought permission to withdraw the appeal. Consequently, the Tax Case Appeal was dismissed as withdrawn. No costs were awarded. The court did not make any findings on the penalty or the gratuity deduction issue.

What were the facts?

The assessee, M/s. International Flavours & Fragrances India P. Ltd., filed an appeal before the High Court of Judicature at Madras against an order of the Income Tax Appellate Tribunal (ITAT), Chennai. The ITAT's order, dated 15.02.2016, was in relation to ITA No. 1387/Mds/2014 for the Assessment Year 2006-07. The appeal was admitted on 14.02.2007. The dispute pertains to the levy of penalty under Section 271(1)(c) of the Income Tax Act, 1961. Subsequent to the admission of the appeal, the Direct Tax Vivad Se Vishwas Act, 2020, was enacted. The assessee informed the court that they had filed the necessary forms under this Act, and the department had issued a corresponding form. Consequently, the assessee sought to withdraw the appeal.

What were the issues?

1. Whether, in the facts and circumstances of the case and in law, the Tribunal was justified in confirming the levy of penalty under section 271(1)(c) of the Income Tax Act, 1961? 2. Whether, in the facts and circumstances of the case and in law, a claim of deduction on account of payment of gratuity in the computation of total income could tantamount to "furnishing of inaccurate particulars of income" so as to attract the levy of penalty under section 271(1) of the Act, especially when the said item was mentioned in the tax audit report? Assessee's Contention: The assessee's counsel sought permission to withdraw the appeal, stating that the assessee had availed the benefit of the Direct Tax Vivad Se Vishwas Act, 2020, by filing the requisite forms. No specific arguments were presented on the merits of the penalty under Section 271(1)(c) or the gratuity deduction issue. Revenue's Contention: The revenue's counsel did not present any arguments on the merits of the appeal, as the appeal was being withdrawn by the assessee.
