What did the High Court hold?

The High Court did not decide the substantial question of law framed for consideration. This was due to subsequent developments, specifically the enactment of the Direct Tax Vivad Se Vishwas Act, 2020. The assessee informed the Court that they had been issued Form-3 under this Act on 30.12.2020 and sought permission to withdraw the appeal. Consequently, the Tax Case Appeal was dismissed as withdrawn. No finding was reached on the merits of the addition of Rs.17,00,000/- or the assessee's compliance with Section 68. The operative direction was the dismissal of the appeal as withdrawn.

What were the facts?

The assessee, M. Sanjay Kumar, filed an appeal under Section 260A of the Income Tax Act, 1961, challenging an order dated 30.01.2015 passed by the Income Tax Appellate Tribunal, Chennai Bench. The appeal pertains to Assessment Year 2009-10. The core of the dispute involved an addition of Rs. 17,00,000/- made by the revenue as 'unexplained' cash deposits. The assessee contended that they had discharged their obligation to identify creditors, prove their creditworthiness, and establish the genuineness of the transactions. The High Court admitted the appeal on a substantial question of law.

What were the issues?

1. Whether, on the facts and in the circumstances of the case, the Appellate Tribunal was right in law in holding that the addition of Rs.17,00,000/- as 'unexplained' cash deposits under Section 68 of the Act, when the appellant had clearly discharged her duty to identify the creditor, prove the creditworthiness of the creditors and the genuineness of the transaction? Assessee's contention: The assessee argued that they had fulfilled their onus under Section 68 by identifying the creditors, proving their creditworthiness, and demonstrating the genuineness of the cash deposits. Revenue's contention: The judgment does not record specific arguments made by the revenue on this issue.
