What did the High Court hold?

The High Court dismissed the appeal filed by the Revenue on the ground of low tax effect, as per CBDT Circular No. 17/2019. The Court noted the submission by the Revenue that the tax effect was below the enhanced monetary limit for pursuing appeals before the High Court. Consequently, the substantial question of law framed at the time of admission was left undecided. The Court granted liberty to the Revenue to seek restoration of the appeal if the tax effect was found to be above the threshold limit, to be heard and decided on merits. No costs were awarded.

What were the facts?

The Revenue, Commissioner of Income-tax, Coimbatore, filed an appeal before the High Court of Madras against an order dated 11.06.2013 passed by the Income Tax Appellate Tribunal (ITAT), Chennai. The appeal concerned the assessment year 2009-10 and challenged the ITAT's decision that proceeds from the sale of Certified Emission Reduction (CER) credits, earned by the assessee, M/s. Salona Cotspin Limited, through its wind energy operations under the Clean Development Mechanism, were a capital receipt and not taxable. The High Court admitted the appeal on a substantial question of law.

What were the issues?

1. Whether, on the facts and circumstances of the case, the Tribunal was right in holding that the proceeds realized by the assessee on sale of Certified Emission Reduction Credit, which the assessee had earned on the Clean Development Mechanism in its wind energy operations, is a capital receipt and not taxable? (Question of law) Assessee's Contention: Not recorded. Revenue's Contention: The Revenue did not argue the merits of the case. Instead, it submitted that the appeal was not being pursued due to low tax effect, citing CBDT Circular No. 17/2019 which increased the monetary limit for pursuing appeals before the High Court to Rs. 1 Crore. The tax effect in this case was stated to be below this threshold.
