What did the High Court hold?

The High Court noted that the Revenue's counsel brought to its attention CBDT Circular No. 17/2019, which mandates that appeals shall not be filed or pursued before the High Court if the tax effect does not exceed Rs. 1,00,00,000/-. The Revenue submitted that the tax effect in the present appeal was less than this threshold limit. In light of this submission, the High Court dismissed the appeal as withdrawn. The court explicitly stated that the substantial questions of law were kept open for determination in an appropriate case. No costs were awarded.

What were the facts?

The Revenue, Commissioner of Income Tax, Chennai, filed a Tax Case Appeal before the High Court of Judicature at Madras, challenging an order dated 28.08.2015 passed by the Income Tax Appellate Tribunal (ITAT), 'C' Bench, Chennai. The appeal pertained to assessment year 2011-12 and concerned an order passed by the ITAT. The High Court admitted the appeal on specific substantial questions of law. During the hearing, the Revenue's counsel brought to the court's attention CBDT Circular No. 17/2019, which stipulates that appeals shall not be filed or pursued before the High Court if the tax effect does not exceed Rs. 1,00,00,000/-. The Revenue submitted that the tax effect in this appeal was below the threshold limit.

What were the issues?

The High Court was to decide the following substantial questions of law: 1. Whether the Tribunal was correct in holding that an order passed under Section 263 directing the Assessing Officer to initiate penalty proceedings under Section 271(1)(c) is not valid? 2. Whether the Tribunal was correct in holding that the machinery was put to use for more than 180 days and was entitled to full depreciation, especially when it was not used for more than 180 days? 3. Whether the Tribunal's finding is bad, considering that the payment of CENVAT was made by the assessee only on 04.10.2010 after examination by customs officials, which would indicate the machinery was used for less than 6 months? Contentions: Assessee: Not recorded in the judgment. Revenue: The tax effect in the appeal is less than the monetary limit prescribed by CBDT Circular No. 17/2019, therefore the appeal should not be pursued.
