What did the High Court hold?

The High Court dismissed the appeals as withdrawn. The dismissal was based on the submission by the Revenue that the tax effect in these appeals was less than the threshold limit stipulated in CBDT Circular No. 17/2019. The Court noted that the appeals were being dismissed in light of this submission and the circular. The substantial questions of law were kept open for determination in appropriate cases. No costs were awarded. The operative direction was to dismiss the appeals as withdrawn and close the connected miscellaneous petition.

What were the facts?

These are appeals by the Revenue against a common order of the Income Tax Appellate Tribunal (ITAT) dated 29.10.2015, concerning assessment years 2000-01 and 2001-02. The ITAT's order was under challenge before the High Court. The High Court admitted the appeals on specific substantial questions of law. During the hearing, the Revenue brought to the court's notice CBDT Circular No. 17/2019, which stipulates that appeals shall not be filed or pursued if the tax effect does not exceed Rs. 1,00,00,000/-. The Revenue submitted that the tax effect in these appeals was below this threshold.

What were the issues?

The High Court had to decide the following substantial questions of law: 1. Whether the Tribunal was correct in holding that the Assessing Officer loses jurisdiction under Section 147 when no addition is made on account of escaped income as per reasons recorded, and cannot proceed with other additions/disallowances, rendering the consequent assessment invalid? 2. Whether the Tribunal was correct in not applying Explanation 3 to Section 147 of the Income Tax Act? 3. Whether the Tribunal was right in quashing the reassessment when the assessee filed a return in response to a Section 148 notice and participated in the reassessment proceedings? Assessee's arguments: The judgment does not record any specific arguments made by the assessee. The assessee's participation in the reassessment proceedings is noted as a fact in question (iii). Revenue's arguments: The Revenue's primary submission was based on CBDT Circular No. 17/2019, stating that the tax effect in these appeals was below the monetary limit for filing/pursuing appeals before the High Court.
