M/S.RAVIKUMAR DISTILLERIES L vs. THE ASSISTANT COMMISSIONER
What did the High Court hold?
The High Court did not decide the substantial questions of law due to subsequent developments. The enactment of the Direct Tax Vivad Se Vishwas Act, 2020, allowed the assessee to resolve the disputed tax. The assessee informed the court that they had availed the benefit under this Act and sought to withdraw the appeals. The Court noted that the assessee had been issued Form-3 under the Act. Consequently, the appeals were dismissed as withdrawn. The Court granted liberty to the assessee to restore the appeals if the decision under the Vivad Se Vishwas Act was not in their favour. The substantial questions of law were left undecided.
What were the facts?
The assessee, M/s. Ravikumar Distilleries Ltd., filed appeals before the High Court of Judicature at Madras against the order of the Income Tax Appellate Tribunal (ITAT), Chennai Bench. The appeals pertained to assessment years 2007-08 and 2010-11. The ITAT's order upheld the disallowance of certain expenses and mandated tax deduction at source on composite payments. The appeals were filed under Section 260A of the Income Tax Act, 1961. During the pendency of these appeals, the Direct Tax Vivad Se Vishwas Act, 2020, was enacted. The assessee informed the court that they had availed the benefits under this Act and sought to withdraw the appeals.
What were the issues?
The Tribunal had to decide the following substantial questions of law: 1. Whether the disallowance under Section 40(a)(ia) was justified in respect of reimbursement of operational support cost to supporting manufacturers. 2. Whether a composite payment including operational support cost and royalty should be treated as royalty, mandating TDS on the entire payment. 3. Whether TDS was required on the entire composite payment comprising operational support cost and royalty. 4. Whether, as per the tie-up agreement, the reimbursement of operational support cost falls outside the purview of Sections 30 to 38, making TDS provisions inapplicable for disallowance under Section 40(a)(ia). The Assessee contended that the reimbursement of operational support cost was not subject to TDS and therefore, the disallowance under Section 40(a)(ia) was incorrect. The Revenue contended that the composite payment should be treated as royalty, requiring TDS on the entire amount. The judgment does not explicitly record arguments from either side on all points, but the questions framed indicate the core dispute.
