PRINCIPAL COMMISSIONER OF vs. SMT. D. RAJESHWARI
What did the High Court hold?
The High Court of Judicature at Madras dismissed the appeal filed by the Revenue. The dismissal was based on the submission by the Revenue's counsel that the appeal was not being pursued due to a low tax effect, as per CBDT Circular No. 17/2019. This circular increased the monetary limit for filing or pursuing appeals before the High Court to Rs. 1 Crore, and the tax effect in this case was stated to be below this limit. Consequently, the substantial questions of law framed for the appeal were left open. The court granted liberty to the Revenue to seek restoration of the appeal if the tax effect was found to be above the threshold limit, allowing it to be heard and decided on merits. No costs were awarded.
What were the facts?
This case involves a Tax Case Appeal filed by the Principal Commissioner of Income Tax-2, Coimbatore (the Revenue) against an order of the Income Tax Appellate Tribunal, Chennai 'C' Bench, dated April 4, 2017. The appeal pertains to the assessment year 2010-11. The Revenue is challenging the Tribunal's decision to grant exemption to the assessee, Smt. D. Rajeshwari, under Section 54 and Section 54F of the Income Tax Act, 1961. The appeal was admitted by the High Court of Judicature at Madras on December 13, 2017, on specific substantial questions of law. The amount in dispute is not explicitly stated but is implied to be below the threshold for appeal.
What were the issues?
The Tribunal had to decide two substantial questions of law: 1. Whether the Income Tax Appellate Tribunal was correct in granting exemption to the assessee under Section 54 of the Income Tax Act, 1961. 2. Whether the Income Tax Appellate Tribunal correctly interpreted the provisions of Sub-Section (4) of Section 54F of the Income Tax Act, 1961, and granted exemption to the assessee under Section 54F on a belated return of income filed under Section 139(4) on March 31, 2012. The Revenue argued that the appeal was not being pursued due to low tax effect, citing Circular No. 17/2019 of the Central Board of Direct Taxes, which increased the monetary limit for pursuing appeals before the High Court to Rs. 1 Crore. The Revenue stated that the tax effect in this case was below this threshold. The judgment does not record any specific arguments from the assessee regarding the merits of the case, as the appeal was dismissed on procedural grounds.
