What did the High Court hold?

The High Court dismissed the appeals filed by the Revenue on the ground of low tax effect. The court noted that the tax effect involved was Rs. 20,83,790/-, which was below the threshold limit stipulated in Circular No. 3/2018 dated 11.07.2018. However, the court granted liberty to the Revenue to restore the appeals if they found that the appeals were not hit by the monetary limit of the circular. Consequently, the substantial questions of law were left undecided. The operative direction was to dismiss the appeals with liberty to restore, and the connected miscellaneous petition was closed.

What were the facts?

The Revenue has filed these appeals under Section 260A of the Income-tax Act, 1961, against a common order dated 05.03.2018, passed by the Income-tax Appellate Tribunal (ITAT) 'A' Bench, Chennai. The appeals pertain to the assessment year 2013-14 and challenge the ITAT's decision regarding deductions claimed by the assessee, Shri A.M. Subramanian. The tax effect involved in these appeals is stated to be Rs. 20,83,790/-. The Revenue's appeals are being considered by the High Court.

What were the issues?

The Tribunal had to decide the following substantial questions of law: 1. Whether the ITAT was correct in law in allowing deduction under Section 54F for the entire value of a commercial building constructed, which is contrary to the provision allowing deduction only for the purchase or construction of a new residential house. 2. Whether the ITAT was correct in law in directing the Assessing Officer to grant the benefit of deduction under Section 54F without adjudicating on the grounds raised by the Revenue regarding the allowance of deduction on the value of land. Contentions of the Revenue: The Revenue argued that the deduction under Section 54F is permissible only for residential houses, not commercial buildings, and that the ITAT erred in allowing it for the entire value of the constructed property. Furthermore, the Revenue contended that the ITAT failed to adjudicate on its grounds concerning the allowance of deduction on the value of land. Contentions of the Assessee: No specific contentions for the assessee are recorded in the judgment.
