What did the High Court hold?

The High Court dismissed the appeals as withdrawn. This decision was based on the submission by the Revenue that the tax effect in these appeals was less than the monetary limit of Rs.1,00,00,000/- stipulated in CBDT Circular No.17/2019. The court noted that appeals shall not be filed or pursued by the Department in such cases. Consequently, the substantial questions of law were kept open for determination in appropriate cases. No costs were awarded. The specific findings or reasoning on the merits of the disallowance under Section 40(a)(i) or the applicability of TDS provisions to the foreign payment were not addressed due to the dismissal as withdrawn.

What were the facts?

The Revenue (Commissioner of Income Tax) filed two appeals (T.C.A.Nos.660 & 661 of 2016) before the High Court of Madras against the common order dated 01.02.2016 passed by the Income Tax Appellate Tribunal (ITAT), Chennai. These appeals pertained to assessment years 2006-07 and 2007-08 and challenged the ITAT's deletion of disallowances made by the Assessing Officer. The High Court admitted these appeals on substantial questions of law on 01.09.2016. Subsequently, during the hearing, the Revenue brought to the court's notice CBDT Circular No.17/2019, which stipulates that appeals should not be filed or pursued if the tax effect does not exceed Rs.1,00,00,000/-. The Revenue submitted that the tax effect in these appeals was below this threshold.

What were the issues?

The High Court was to decide two substantial questions of law: 1. Whether, on the facts and circumstances, the Tribunal was correct in deleting the disallowance made by the Assessing Officer under Section 40(a)(i) concerning insurance costs accounted under 'insurance Costs' and 'Insurance general'. 2. Whether, on the facts and circumstances, the Tribunal was correct in holding that the assessee was justified in not deducting tax at source on payments to a foreign party, on the grounds that there was no element of taxable income, contrary to the Supreme Court's decision in Transmission Corporation of Andhra Pradesh Ltd. (239 ITR 587). The Revenue argued that the Tribunal erred in deleting the disallowance under Section 40(a)(i) and in holding that TDS was not required on payments to the foreign party, citing the Supreme Court judgment. The assessee's arguments are not explicitly recorded in the provided text.

Which sections of the Income-tax Act were involved?
