What did the High Court hold?

The High Court noted that it was not necessary to decide the substantial questions of law due to subsequent developments. The Government of India enacted the Direct Tax Vivad Se Vishwas Act, 2020, for the resolution of disputed tax. The learned counsel for the appellant/assessee informed the Court that Form-3 had been issued to the assessee under this Act and sought permission to withdraw the appeal. Consequently, the High Court dismissed the Tax Case Appeal as withdrawn. No specific finding was given on the substantial questions of law, and the issue of Goodwill expenditure was not adjudicated on merits. The operative direction was to dismiss the appeal as withdrawn.

What were the facts?

The assessee, M/s. Sakthi Sugars Ltd., filed an appeal before the High Court of Judicature at Madras against an order dated January 13, 2017, passed by the Income Tax Appellate Tribunal (ITAT), Madras 'D' Bench. The appeal pertains to the assessment year 2009-10. The assessee challenged the ITAT's decision on three substantial questions of law concerning the refusal to remit additional evidence, the conclusion regarding advances, and the disallowance of goodwill expenditure. The Revenue was represented by the Assistant Commissioner of Income Tax, Corporate Range-1, Coimbatore. The High Court was informed that the assessee had been issued Form-3 under the Direct Tax Vivad Se Vishwas Act, 2020.

What were the issues?

The High Court was asked to decide the following substantial questions of law: 1. Whether the ITAT's order refusing to remit additional evidence (ledger accounts) to the Assessing Officer/CIT (Appeals) for fresh consideration was perverse in law? 2. Whether the ITAT erred in concluding, without considering ledger copies, that in the absence of evidence regarding the genuineness and purpose of advances/loans and confirmations from borrowers, the matter should not be remitted to the AO/CIT(A) for fresh consideration? 3. Whether the ITAT was right in law in holding that the amount spent towards Goodwill, in the nature of an advance to farmers through Dhenkanal Water User's Society for improving irrigation facilities to ensure sugarcane supply, and written off as irrecoverable, is not allowable as a deduction under Section 37 or as a business loss under Section 28(i) of the Income Tax Act, 1961? The assessee contended that the ITAT's refusal to remit the matter for fresh consideration was perverse and that the ledger copies filed supported their claim. The Revenue's contentions are not explicitly recorded in the judgment.

Which sections of the Income-tax Act were involved?

Section 260A,Section 37,Section 28(i)
