THE COMMISSIONER OF INCOME T vs. M/S. Q SOURCE GLOBAL CONSULT
What did the High Court hold?
The High Court dismissed the appeals filed by the Revenue. The dismissal was based on the Revenue's submission that the appeals were not being pursued due to a low tax effect, in line with CBDT Circular No.17/2019 which increased the monetary limit for filing appeals before the High Court to Rs.1 Crore. The Court noted that the tax effect in these cases was below the threshold limit. Consequently, the substantial questions of law were left open. The Revenue was granted liberty to mention the case for restoration if the tax effect was found to be above the threshold limit. The connected miscellaneous petition was also dismissed. No costs were awarded.
What were the facts?
The Commissioner of Income Tax, Chennai (the Revenue) filed two appeals (TCA.Nos.630 & 631/2019) before the High Court of Judicature at Madras against the common order dated 01.5.2018 passed by the Income Tax Appellate Tribunal (ITAT), Chennai 'C' Bench. The appeals pertained to assessment years 2013-04 and 2014-15 and challenged the ITAT's deletion of additions made by the Assessing Officer concerning belated payments of employees' contribution towards provident fund/ESI. The amount in dispute was not explicitly stated but was referred to as having a low tax effect.
What were the issues?
The Tribunal had to decide two substantial questions of law raised by the Revenue: 1. Whether the Tribunal was correct in deleting additions made under Section 2(24)(x) read with Section 36(1)(va) of the Income Tax Act, 1961, holding that belatedly paid employees' contribution towards provident fund/ESI was eligible for deduction when the section prohibits such allowance. 2. Whether deduction is permissible for belated payments of employees' contribution towards ESI/pension funds, especially when Section 2(24)(x) read with Section 36(1)(va) refers to sums received as employees' contribution and not employer's contribution, and such sums become income in the assessee's hands if credited to the fund beyond the specified due dates. The Revenue argued that the ITAT erred in allowing deductions for belated payments. The assessee's arguments are not recorded in the judgment.
