ABAN HOTELS AND RESORTS P LTD vs. THE INCOME TAX OFFICER
What did the High Court hold?
The High Court did not decide the substantial questions of law framed for consideration. This was due to a subsequent development, namely, the enactment of the Direct Tax Vivad Se Vishwas Act, 2020. The learned counsel for the appellant/assessee informed the Court that the assessee had already been issued with Form-3 under this Act and sought permission to withdraw the appeal. In view of this submission, the High Court dismissed the Tax Case Appeal as withdrawn. The operative direction was the dismissal of the appeal. No issue was expressly left undecided, as the appeal was withdrawn.
What were the facts?
The assessee, M/s. Aban Hotels & Resorts P Ltd., filed an appeal before the High Court of Judicature at Madras against an order dated 07.12.2016 passed by the Income Tax Appellate Tribunal (ITAT), Madras "C" Bench. The appeal pertained to assessment year 2005-06. The ITAT's order was challenged based on two substantial questions of law concerning the taxability of compensation received by the appellant for the cancellation of a joint venture agreement. The High Court admitted the appeal on 11.12.2017. Subsequently, the Government of India enacted the Direct Tax Vivad Se Vishwas Act, 2020. The assessee informed the court that they had been issued Form-3 under this Act and sought to withdraw the appeal.
What were the issues?
The High Court was to decide two substantial questions of law: 1. Whether the Tribunal was correct in holding that the compensation received by the appellant for the cancellation of a joint venture agreement is a business receipt chargeable to tax? 2. Whether the compensation received on the cancellation of the joint venture agreement, resulting in the dissolution of the profit-making apparatus, is a capital receipt not chargeable to tax? The assessee contended that the compensation was a capital receipt, not taxable. The revenue's contentions are not explicitly recorded in the judgment. However, the Tribunal had previously held the receipt to be a business receipt chargeable to tax, forming the basis of the appeal. The court noted the enactment of the Direct Tax Vivad Se Vishwas Act, 2020, as a subsequent development impacting the need to decide these questions.
