What did the High Court hold?

The High Court dismissed the appeal filed by the Revenue. The dismissal was based on the Revenue's submission that the appeal was not being pursued due to low tax effect, as per CBDT Circular No. 17/2019, which increased the monetary limit for filing appeals before the High Court to Rs. 1 Crore. The Court noted that the tax effect in this case was below the threshold limit. Consequently, the substantial questions of law framed were left open. The Revenue was granted liberty to mention the case for restoration if the tax effect was found to be above the threshold limit, allowing the appeal to be heard and decided on merits.

What were the facts?

The Revenue, represented by the Principal Commissioner of Income Tax, filed an appeal under Section 260A of the Income Tax Act, 1961, against an order dated March 21, 2019, passed by the Income Tax Appellate Tribunal (ITAT), Madras 'D' Bench. The appeal pertains to assessment year 2011-12 and concerns the assessee, M/s. Space N Place Promoters P. Ltd. The core of the dispute revolves around cash transactions in the assessee's current account and whether they attracted provisions related to loans and advances. The ITAT had previously ruled in favour of the assessee.

What were the issues?

1. Whether, on the facts and in law, the ITAT was correct in holding that cash transactions in a current account cannot be considered as loans or advances, thereby not attracting the provisions of Section 269SS of the Income Tax Act, 1961? 2. Whether, on the facts and in law, the ITAT ought to have followed the decision of the Division Bench of the Madras High Court in Vasan Healthcare (P) Ltd. vs. Addl. CIT, which held that cash remittances accepted by an assessee-company in contravention of Section 269SS exposed them to penalty under Section 271D? Assessee's arguments: Not recorded in the judgment. Revenue's arguments: The Revenue contended that the ITAT's decision was incorrect and that the case should have been decided in its favour, citing the precedent set in Vasan Healthcare (P) Ltd. vs. Addl. CIT. The Revenue also argued that the cash remittances accepted by the assessee were in contravention of Section 269SS and thus liable for penalty under Section 271D.

Which sections of the Income-tax Act were involved?

Section 260A,Section 269SS,Section 271D
