What did the High Court hold?

The High Court noted that the Revenue, through its counsel, brought to its attention CBDT Circular No. 17/2019. This circular mandates that appeals shall not be filed or pursued by the Department before the High Court if the tax effect does not exceed Rs. 1,00,00,000/-. The Revenue submitted that the tax effect in the present appeal falls below this stipulated monetary limit. In light of this submission and the circular, the High Court found no reason to proceed with the determination of the substantial questions of law. The appeal was accordingly dismissed as withdrawn, with the court explicitly stating that the substantial questions of law remain open for determination in an appropriate future case. No costs were awarded.

What were the facts?

The Revenue, Commissioner of Income Tax, Company Circle III, Chennai, filed an appeal under Section 260A of the Income Tax Act, 1961, against an order dated 31.12.2015 passed by the Income Tax Appellate Tribunal (ITAT), Chennai, in ITA No. 527/Mds/2014. This order pertained to the assessment year 2008-09 and concerned disallowance of freight and transport payments under Section 40(a)(ia) for non-remittance of Tax Deducted at Source (TDS). The High Court admitted the appeal on substantial questions of law. Subsequently, the Revenue brought to the court's notice CBDT Circular No. 17/2019, which stipulates that appeals with a tax effect not exceeding Rs. 1,00,00,000/- should not be filed or pursued.

What were the issues?

1. Whether the Tribunal was correct in holding that only the outstanding contract expenditure payable without TDS as of March 31st of the accounting year is subject to disallowance under Section 40(a)(ia) of the Income Tax Act? (Question of law) 2. Whether the Tribunal was correct in deleting the disallowance of the entire sum of freight and transport payments made or payable during the previous year under Section 40(a)(ia) for failure to remit TDS by the due date of filing the return of income? (Question of mixed law and fact) Assessee's contentions: Not recorded in the judgment. Revenue's contentions: The Revenue relied on CBDT Circular No. 17/2019, stating that the tax effect in this appeal is less than the threshold limit of Rs. 1,00,00,000/-. Therefore, the appeal should not be pursued.
