M.CT.M.GLOBAL INVESTMENTS P. vs. THE DEPUTY COMMISSIONER OF I
What did the High Court hold?
The High Court did not decide the substantial questions of law. It was informed by the appellant's counsel that the assessee had availed the benefit of the Direct Tax Vivad Se Vishwas Act, 2020. Forms-3 were issued to the assessee for the respective assessment years (January 27, 2021, and January 31, 2021). Consequently, the appellant sought permission to withdraw the appeals. In light of this submission, the High Court dismissed the Tax Case Appeals as withdrawn. No costs were awarded. The core principle underlying this decision is the allowance of withdrawal of appeals when parties opt for a settlement scheme like Vivad Se Vishwas, thereby rendering the adjudication of the legal questions moot.
What were the facts?
These appeals were filed by the Revenue against an order of the Income Tax Appellate Tribunal (ITAT), Chennai Bench, for Assessment Years 2010-2011, 2011-2012, and 2012-2013. The appeals concerned the taxability of income earned by the appellant's Malaysian branch, the allowability of expenditure incurred by that branch, and the classification of interest and dividend income. The High Court noted that the Direct Tax Vivad Se Vishwas Act, 2020, had been enacted. The appellant informed the court that they had received Form-3 under the Vivad Se Vishwas Act for the relevant assessment years, and therefore, sought permission to withdraw the appeals.
What were the issues?
The Tribunal had to decide six substantial questions of law: 1. Whether the income earned by the Malaysian branch of the appellant company is taxable in India and not in Malaysia. 2. Whether expenditure incurred by the Malaysian branch can be treated as allowable expenditure even if its income was treated as taxable in India. 3. Whether expenditure incurred for earning income must be allowed either under Section 37 (business) or Section 56 (other sources) of the Income Tax Act, 1961, based on the income's classification. 4. Whether interest income earned by a non-banking financial company in the course of its business activity should be classified as 'income from other sources' or 'income from business'. 5. Whether dividend income is liable to be taxed under the head 'income from other sources' or 'income from business'. 6. Whether the ITAT was right in rejecting the appellant's claim that income derived in Malaysia constituted business income, given the appellant's systematic and continuous business of purchase/sale of investments. Assessee's Contention: The appellant, through its counsel, informed the court that it had opted for the Vivad Se Vishwas scheme and had been issued Form-3, leading to a request for withdrawal of the appeals. Revenue's Contention: The judgment does not record any specific arguments made by the Revenue on the substantial questions of law.
