What did the High Court hold?

The High Court noted that during the pendency of the Tax Case Appeal, the assessee had filed the requisite Forms 1 and 2 under Section 4 of the Direct Tax Vivad Se Vishwas Act, 2020. These forms were accepted, and Form 3 was issued to the assessee on 08.04.2021 by the Income Tax Department. The Revenue's counsel fairly conceded this development. In light of the assessee having availed the benefit conferred under the beneficial legislation enacted for the resolution of disputed tax matters, the Court found it unnecessary to decide the substantial questions of law raised in the appeal. The appeal was disposed of, directing the department to process the application in accordance with the Vivad Se Vishwas Act and communicate the decision to the assessee at the earliest. No costs were awarded. The specific findings on the interpretation of Section 32(1)(iia) were not rendered due to the settlement under the Vivad Se Vishwas Act.

What were the facts?

The appellant, M/s. CRI Pumps P Ltd, filed a Tax Case Appeal before the High Court of Judicature at Madras, challenging an order dated 23.11.2016 passed by the Income Tax Appellate Tribunal, Chennai ('the Tribunal'), in I.T.A.No.1049/Mds/2016. The appeal pertains to the Assessment Year 2011-2012. The core of the dispute involved the assessee's claim for additional depreciation under Section 32(1)(iia) of the Income Tax Act, 1961. During the pendency of the appeal, the assessee filed declarations under the Direct Tax Vivad Se Vishwas Act, 2020, which were accepted, and Form 3 was issued by the Income Tax Department.

What were the issues?

The Tribunal had to decide the following substantial questions of law: 1. Whether the Appellate Tribunal correctly interpreted Section 32(1)(iia) of the Income Tax Act, 1961, to restrict the claim of additional depreciation to the first year of installation and use, rather than allowing it in subsequent assessment years. 2. Whether the Income Tax Appellate Tribunal was correct in rejecting the appellant's claim for additional depreciation under Section 32(1)(iia) of the Act. 3. Whether the Appellate Tribunal correctly interpreted Section 32(1)(iia) of the Act by not considering its legislative history and the principles of harmonious interpretation. Assessee's Contention: The assessee argued that they had availed the benefit of the Direct Tax Vivad Se Vishwas Act, 2020, by filing the requisite forms, which were accepted and Form 3 was issued. Therefore, the appeal need not be decided on merits. Revenue's Contention: The learned senior standing counsel for the Revenue fairly conceded the submission made by the assessee regarding the availing of the benefit under the Vivad Se Vishwas Act.
