PRINCIPAL COMMISSIONER OF vs. M/S SARAVANA STORES (TEX)
What did the High Court hold?
The High Court dismissed the appeals filed by the Revenue. The dismissal was based on the Revenue's submission that the appeals were not being pursued due to a low tax effect, as per Circular No. 17/2019 issued by the Central Board of Direct Taxes, which increased the monetary limit for appeals before the High Court to Rs. 1 Crore. The Court noted that the tax effect in these cases was below the threshold. Consequently, the substantial questions of law framed were left open. The Revenue was granted liberty to mention the cases for restoration if the tax effect was found to be above the threshold limit, allowing for a decision on merits. No costs were awarded.
What were the facts?
The Revenue, represented by the Principal Commissioner of Income Tax, Central I, Chennai, filed these appeals under Section 260A of the Income Tax Act, 1961, against the common order dated 30.11.2017 passed by the Income Tax Appellate Tribunal (ITAT), Chennai 'A' Bench. The appeals pertain to assessment years 2006-07, 2007-08, 2008-09, and 2009-10. The ITAT's order was challenged by the Revenue. The appeals were admitted by the High Court on 16.11.2018, framing substantial questions of law. The amount in dispute is not explicitly stated but is implied to be below a certain threshold by the Revenue's submission.
What were the issues?
The Tribunal was asked to decide the following substantial questions of law: 1. Whether the Appellate Tribunal erred in concluding that assessment under Section 153A of the Income Tax Act can only be based on incriminating material, disregarding the principle that the 'total income' should be determined under the new search assessment procedure, not just income related to the search. 2. Whether the narrow interpretation of Section 153A by the Appellate Tribunal is legally valid. 3. Whether, under Section 153A, the Assessing Officer is entitled to bring to tax all hitherto untaxed income, in addition to income discovered during a search under Section 132. The Revenue argued that the ITAT's interpretation of Section 153A was too narrow and that the AO should be able to tax all untaxed income. The Revenue relied on Circular No. 17/2019 of the CBDT regarding low tax effect. The judgment does not record specific arguments from the assessee regarding these questions, other than their appearance through counsel.
