PRINCIPAL COMMISSIONER OF vs. M/S.GREENLAND EXPORTS PVT LT
What did the High Court hold?
The High Court dismissed the appeal filed by the Revenue on the ground of low tax effect, citing CBDT Circular No.17/2019. The Court noted that the tax effect in this case was below the increased monetary limit for filing or pursuing appeals before the High Court, which is Rs.1 Crore. Consequently, the substantial questions of law framed were left open. The Revenue was granted liberty to seek restoration of the appeal if the tax effect was found to be above the threshold limit. No costs were awarded. The specific findings on the substantial questions of law were not adjudicated on merits.
What were the facts?
The Revenue, Principal Commissioner of Income Tax-2, Chennai, filed an appeal under Section 260A of the Income Tax Act, 1961, against an order dated 28.12.2015 passed by the Income Tax Appellate Tribunal (ITAT), Chennai 'D' Bench. The appeal pertains to assessment year 2008-09 and challenges the ITAT's decision regarding the determination of the Arm's Length Price (ALP) for transactions involving the assessee, M/s. Greenland Exports Pvt. Ltd., Chennai. The dispute concerns the quantum of upward revision of income. The High Court admitted the appeal on substantial questions of law.
What were the issues?
The High Court was to decide the following substantial questions of law: 1. Whether the ITAT was right in restricting the quantum of upward revision by adopting ALP at Rs.18.18 crores as against Rs.16.42 crores determined by the Assessing Officer (AO)? 2. Whether the ITAT's finding was perverse in holding that Internal TNMM (Transactional Net Margin Method) could be used for ALP determination when uncontrolled entities maintained by the assessee are associate enterprises, hit by Section 92A(2)(i) of the Income Tax Act? 3. Whether the ITAT was right in not considering that transactions with related parties were taken into account while computing ALP, which is against statutory provisions? The Revenue argued that the ITAT's findings were perverse and contrary to statutory provisions. The assessee's arguments are not recorded in the judgment.
