COMMISSIONER OF INCOME TAX vs. SHRI.R.KRISHNAMOORTHY
What did the High Court hold?
The High Court dismissed the appeal as withdrawn. The dismissal was based on the submission by the Revenue's counsel that the tax effect in the appeal was less than the threshold limit of Rs. 1,00,00,000/- stipulated in CBDT Circular No. 17/2019. The circular directs that appeals shall not be filed or pursued by the Department before the High Court in cases where the tax effect does not exceed this amount. Consequently, the substantial questions of law were not decided on merits. The court explicitly stated that the substantial questions of law were kept open for determination in an appropriate case. No costs were awarded.
What were the facts?
The Commissioner of Income Tax (Revenue) filed an appeal under Section 260A of the Income Tax Act, 1961, against an order dated 04.02.2015 passed by the Income Tax Appellate Tribunal (ITAT), Chennai. The appeal pertained to assessment year 2009-10 and challenged the ITAT's cancellation of a penalty levied under Section 271(1)(c) of the Act. The High Court admitted the appeal on substantial questions of law. During the hearing, the Revenue's counsel brought to the court's attention CBDT Circular No. 17/2019, which stipulates that appeals shall not be filed or pursued if the tax effect does not exceed Rs. 1,00,00,000/-. The Revenue submitted that the tax effect in this appeal was below this threshold.
What were the issues?
1. Whether, on the facts and circumstances of the case, the Appellate Tribunal was right in cancelling the penalty levied under Section 271(1)(c) for concealing particulars of income? (Question of law) 2. Whether, on the facts and circumstances of the case, the Appellate Tribunal was right in cancelling the penalty levied without considering Explanation 1 of Section 271(1)(c) of the Income Tax Act? (Question of law) Assessee's contentions: Not recorded in the judgment. Revenue's contentions: The Revenue argued that the appeal should be dismissed as withdrawn because the tax effect was less than the monetary limit stipulated in CBDT Circular No. 17/2019, which guides the department's decision to file or pursue appeals before the High Court.
