PRINCIPAL COMMISSIONER OF vs. INDOWIND ENERGY LTD
What did the High Court hold?
The High Court dismissed the appeal filed by the Revenue. The dismissal was based on the submission by the Revenue's counsel that the appeal was not being pursued due to a low tax effect, falling below the threshold limit stipulated in CBDT Circular No. 17/2019. The Court noted that the substantial questions of law framed at the time of admission were left open. Liberty was granted to the Revenue to seek restoration of the appeal if the tax effect was found to be above the threshold limit, to be heard and decided on merits. No costs were awarded. The specific findings of the ITAT on the deductibility of the advances and the compensation payment were not adjudicated by the High Court.
What were the facts?
The Revenue, Principal Commissioner of Income Tax-2, Chennai, appealed against an order of the Income Tax Appellate Tribunal (ITAT), Chennai 'B' Bench, dated October 25, 2016, concerning assessment year 2006-07. The appeal was filed by the Revenue under Section 260A of the Income Tax Act, 1961. The dispute involved the deductibility of a loss of Rs. 1,02,00,000/- arising from non-recoverable advances made to M/s. Cicon Environment and a compensation payment of Rs. 65 lakhs made to M/s. Indowind Global Ltd. for project delay. The High Court admitted the appeal on substantial questions of law.
What were the issues?
1. Whether, in law, the ITAT was correct in holding that a loss of Rs. 1,02,00,000/- due to non-recoverability of advances made to M/s. Cicon Environment was a business loss allowable under Section 37(1) of the Income Tax Act, as it was not an expenditure incurred by the assessee? 2. Whether the ITAT was correct in holding that advances made to M/s. Cicon Environment were eligible to be claimed as business loss when the proposed project did not materialize and the question of claiming expenses from project commissioning did not arise? 3. Whether, in law, the ITAT was correct in treating a compensation payment of Rs. 65 lakhs to an associate company, M/s. Indowind Global Ltd., for project commissioning delay as a deduction under Section 37 of the Act? Assessee's contentions: Not recorded. Revenue's contentions: The Revenue argued that the appeal was not being pursued due to low tax effect, citing CBDT Circular No. 17/2019 which increased the monetary limit for appeals to the High Court to Rs. 1 Crore. The tax effect in this case was below this threshold.
