COMMISSIONER OF INCOME TAX vs. M/S.SPI MUSIC PRIVATE LTD
What did the High Court hold?
The High Court did not decide the substantial questions of law on merits. The learned counsel for the appellant/Revenue brought to the court's notice Circular No.17/2019 dated 08.08.2019 issued by the CBDT, which stipulates that appeals shall not be filed or pursued by the Department before the High Court if the tax effect does not exceed Rs.1,00,00,000/-. It was submitted that the tax effect in these appeals was less than this threshold limit. Consequently, the High Court dismissed the present appeals as withdrawn, explicitly stating that the substantial questions of law are kept open for determination in appropriate cases. No costs were awarded.
What were the facts?
These four tax case appeals (T.C.A.Nos.552 to 555 of 2019) were filed by the Revenue against the common order dated 20.11.2018 passed by the Income Tax Appellate Tribunal (ITAT), Chennai. The appeals pertain to assessment years 2011-12, 2008-09, 2010-11, and 2009-10, concerning the assessee M/s. SPI Music Private Limited. The High Court admitted these appeals on substantial questions of law on 07.08.2019. The dispute revolves around the treatment of expenses related to music rights, specifically whether they should be treated as revenue expenditure or capitalized as intangible assets.
What were the issues?
The Tribunal had to decide the following substantial questions of law: 1. Whether, on the facts and circumstances of the case, the Income Tax Appellate Tribunal was right in holding that music rights are incapable of sustained exploitation after the first broadcast, and thus, considering the principles of consistency and nature of expenditure, the same should be treated as revenue in nature? (Question of law) 2. Whether, on the facts and circumstances of the case, the Income Tax Appellate Tribunal was right in law in reversing the capitalization of expenses by the assessing officer when, as per accounting standards, copyrights in films/serials are intangible assets, and writing off the entire cost of acquiring such rights at the first broadcast due to unascertainable future revenues, neither adheres to accounting standards nor income tax law? (Question of mixed law and fact) Assessee's contentions: Not recorded in the judgment. Revenue's contentions: Not explicitly detailed, but the appeal challenges the ITAT's findings on the nature of expenditure and capitalization.
