THE COMMISSIONER OF INCOME vs. M/S COGNIZANT TECHNOLOGY
What did the High Court hold?
The High Court dismissed the appeal filed by the Revenue on account of low tax effect, as per CBDT Circular No. 17/2019. The Court noted the submission by the Revenue's counsel that the tax effect was below the threshold limit of Rs. 1 Crore for pursuing appeals before the High Court. Consequently, the substantial questions of law framed were left open. The Revenue was granted liberty to mention the case for restoration if the tax effect was found to be above the threshold limit. No costs were awarded. The specific findings of the Tribunal on the four substantial questions of law were not discussed or adjudicated upon by the High Court due to the dismissal on procedural grounds.
What were the facts?
The Revenue, represented by the Commissioner of Income Tax, Chennai, filed an appeal before the High Court of Judicature at Madras against an order dated August 28, 2013, passed by the Income Tax Appellate Tribunal (ITAT), Chennai 'C' Bench. The appeal pertains to the assessment year 2008-09 and challenges the ITAT's decision regarding certain additions made by the Assessing Officer. The assessee is M/s. Cognizant Technology Solutions India Pvt. Ltd. The appeal was admitted on substantial questions of law. However, during the hearing, the Revenue submitted that it was not pursuing the appeal due to low tax effect, citing CBDT Circular No. 17/2019 which increased the monetary limit for filing appeals before the High Court to Rs. 1 Crore.
What were the issues?
The Tribunal had to decide on four substantial questions of law. The first question was whether the Tribunal was correct in holding that expenditure towards recreation and sports clubs is not in the nature of fringe benefits and thus deleting the additions, especially when it was covered under Section 115WB(M)(N). The second question was whether the Tribunal's finding was bad, considering the statute did not differentiate between employer-maintained clubs and third-party clubs when dealing with fringe benefit tax. The third question was whether the Tribunal's finding that travel expenditure incurred for business purposes does not attract Fringe Benefit Tax (FBT) was proper. The fourth question concerned whether interest should be charged under Section 115WJ(3) for short payment of advance tax on fringe benefit tax paid on employee stock option plans. The Revenue argued that the expenditure on clubs was a fringe benefit. The assessee's arguments are not explicitly detailed in the provided text, but their position was upheld by the Tribunal.
