PRINCIPAL COMMISSIONER OF vs. M/S MAHARAJA SATHYAM
What did the High Court hold?
The High Court held that it was not necessary to answer the substantial questions of law raised by the Revenue. This was because, subsequent to the ITAT passing the impugned order recalling its earlier order, the CIT(A) had passed a fresh order on July 27, 2017. In this fresh order, the CIT(A) allowed the revenue's appeal and remanded the matter for fresh consideration to the Assessing Officer. Consequently, the exercise of answering the questions of law in the present appeal filed by the Revenue became academic. The Tribunal's decision to recall the order was based on the principle of affording an opportunity to the assessee in the interest of justice. However, the court did not delve into the merits of whether the recall was justified or whether the Tribunal had the power to review its order, given the subsequent developments. The substantial questions of law were left open.
What were the facts?
The Revenue (Principal Commissioner of Income Tax 2, Coimbatore) filed an appeal before the High Court of Madras against an order of the Income Tax Appellate Tribunal (ITAT), Chennai. The ITAT's order, dated March 10, 2017, recalled its earlier order of November 2, 2016. The earlier order had set aside the Commissioner of Income-Tax(Appeals) order and remanded the issue to the Assessing Officer. The assessee, M/s. Maharaja Sathyam Industries (P) Ltd., had approached the ITAT seeking recall of the November 2, 2016 order, alleging they were not heard. The ITAT recalled the order in the interest of justice, stating the earlier decision was made without affording the assessee an opportunity. The Revenue argued that the ITAT lacked jurisdiction to recall its order, especially after deciding on merits. However, subsequent to the ITAT's impugned order, the CIT(A) passed a fresh order on July 27, 2017, allowing the revenue's appeal and remanding the matter to the Assessing Officer.
What were the issues?
1. Whether the Tribunal is correct in law in holding that the order dated 02.11.2016 is an ex-parte order after considering the case on merits? (Question of law) 2. Whether the Tribunal is correct in reviewing its earlier order dated 02.11.2016 by recalling the same under Section 254 of the Act? (Question of law) 3. Whether the Tribunal is correct in law in holding that the order dated 02.11.2016 is an ex-parte order even after recording the assessee's submissions and allowing the revenue's appeal on merits? (Question of law) Assessee's contentions: The assessee contended that they were not heard before the ITAT passed its order dated November 2, 2016, and provided reasons for their non-appearance. The ITAT agreed that the decision was made without affording an opportunity and recalled the order in the interest of justice. Revenue's contentions: The Revenue argued that the ITAT failed to provide proper reasons for recalling the order, especially since it had decided the matter on merits. The Revenue further contended that the ITAT had no jurisdiction to recall its earlier order, as it did not possess the power to review its own orders, even when invoking Section 254 of the Act. Reliance was placed on Abhishek Industries reported in 286 ITR 1 (Punjab & Haryana), CIT Vs. Earnest Exports Ltd., reported in 323 ITR 577 (Bombay), and CIT Vs. MC. Dowell &Co reported in 310 ITR 215 (Karnataka), arguing that the Tribunal becomes functus officio and loses power to recall its order.

Mr.T.R.Senthil Kumar, learned Senior Standing Counsel for the revenue submitted that the Tribunal failed to give proper reasons for recalling the earlier order dated 02.11.2016, more particularly, when the Tribunal had decided the matter on merits and recorded its findings in paragraph 7 of the order dated 02.11.2016. It may not be necessary for us to render a decision on the grounds raised by the revenue on account of subsequent developments.
