THE COMMISSIONER OF INCOME vs. M/S RXMD PHARMACEUTICAL
What did the High Court hold?
The High Court did not decide the substantial questions of law on merits. Instead, the Revenue's counsel brought to the court's notice Circular No. 17/2019 dated 08.08.2019 issued by the Central Board of Direct Taxes (CBDT). This circular stipulates that appeals shall not be filed or pursued by the Department before the High Court if the tax effect does not exceed Rs. 1,00,00,000/- (Rupees One Crore). The Revenue submitted that the tax effect in the present appeals was less than this threshold limit. Consequently, the High Court dismissed the appeals as withdrawn, based on the Revenue's submission regarding the tax effect and the CBDT circular. The court explicitly stated that the substantial questions of law were kept open for determination in appropriate cases. No costs were awarded. The connected miscellaneous petitions were also closed.
What were the facts?
The Revenue (Commissioner of Income Tax, Chennai) filed two tax case appeals (T.C.A.Nos.528 and 530 of 2016) before the High Court of Judicature at Madras. These appeals challenged a common order dated 30.12.2015 passed by the Income Tax Appellate Tribunal (ITAT), "B" Bench, Chennai. The appeals pertained to assessment years 2009-10 and 2011-12 and concerned the assessee, M/s. RXMD Pharmaceutical Physicians P Ltd. The core of the dispute revolved around the eligibility of the assessee for deduction under Section 10A of the Income Tax Act, 1961, for its medical consultancy services to pharmaceutical companies.
What were the issues?
The High Court was called upon to decide the following substantial questions of law: 1. Whether, on the facts and circumstances of the case, the Tribunal was right in holding that the Assessee is entitled to deduction under Section 10A of the Income Tax Act? 2. Is not the finding of the Tribunal bad by holding that the business of the assessee in relation to medical consultancy services to Pharmaceutical Companies are also eligible for deduction, especially when the CBDT Notification No. SO.890(E) dated 26.09.2000 has not notified pharmaceutical company as doing information technology product or services? Contentions of the Revenue: The Revenue argued that the Tribunal's finding regarding the eligibility for deduction under Section 10A was incorrect. Specifically, they contended that the medical consultancy services provided by the assessee to pharmaceutical companies should not be eligible for deduction because pharmaceutical companies are not listed in CBDT Notification No. SO.890(E) dated 26.09.2000 as entities engaged in information technology products or services. The Revenue relied on this notification to argue against the eligibility. Contentions of the Assessee: The judgment does not record specific contentions made by the assessee's counsel.
