What did the High Court hold?

The High Court noted that the assessee had filed a declaration under the Vivad Se Vishwas Act, 2020. In light of this subsequent event, the Court directed the Competent Authority to process the declaration and pass appropriate orders expeditiously. The appeal was disposed of with liberty granted to the assessee to restore the appeal if the decision on their declaration under the Vivad Se Vishwas Act was not in their favour. Consequently, the substantial questions of law framed for the appeal were left undecided. The operative direction was to process the Vivad Se Vishwas application and allow restoration of the appeal if needed. No costs were awarded.

What were the facts?

The assessee, M/s. FRP Institute, Chennai, filed an appeal before the High Court of Judicature at Madras against an order dated March 20, 2017, passed by the Income Tax Appellate Tribunal (ITAT), Chennai. The appeal concerned the assessment year 2011-12. The ITAT had denied the assessee exemption under Section 11 of the Income Tax Act, 1961. The High Court admitted the appeal on substantial questions of law. Subsequently, the assessee informed the court that they had filed a declaration under the Vivad Se Vishwas Scheme on December 30, 2020, and were awaiting orders.

What were the issues?

The High Court had to decide the following substantial questions of law: 1. Whether the Tribunal was right in denying exemption under Section 11 of the Act on the ground that the assessee did not exist for a charitable purpose as defined in Section 2(15) of the Act? 2. Whether the Tribunal was right in denying exemption under Section 11 merely because there was a surplus of income over expenditure? 3. Whether the Tribunal was right in holding that there was no educational activity by the assessee, disregarding the fact that the assessee imparts education and training in fibre reinforced plastics to institutions and industry? 4. Whether the Tribunal was right in concluding that the assessee was engaged in trade and commerce, falling under the Fourth Proviso to Section 2(15), without considering the predominant nature of the assessee's activity? Assessee's Contention: The assessee's counsel submitted that a declaration had been filed under the Vivad Se Vishwas Scheme. Revenue's Contention: No specific contentions were recorded for the revenue regarding the substantial questions of law.
