What did the High Court hold?

The High Court did not decide the substantial questions of law. It noted the enactment of the Direct Tax Vivad Se Vishwas Act, 2020. The learned counsel for the assessee informed the Court that Form-3 had been issued to the assessee on 10.12.2020 for all assessment years under the Vivad Se Vishwas scheme and sought permission to withdraw the appeals. Consequently, the High Court dismissed all the Tax Case Appeals as withdrawn. No specific finding was given on the merits of the substantial questions of law, nor was any ratio decidendi established for future citation. The operative direction was the dismissal of the appeals as withdrawn.

What were the facts?

The assessee, S. Kavithaa, filed six appeals (TCAs 521 to 526 of 2015) before the High Court of Judicature at Madras. These appeals challenged an order dated 12.12.2013 passed by the Income Tax Appellate Tribunal (ITAT), Chennai 'A' Bench, in ITA Nos. 1984 to 1989/Mds/2012. The assessment years under dispute were 2003-04 to 2008-09. The appeals were admitted on 24.07.2015. The appeals were filed under Section 260A of the Income Tax Act, 1961, against the ITAT's order which had restored penalty under Section 271(1)(c) of the Act.

What were the issues?

The High Court was to decide three substantial questions of law: 1. Whether the Tribunal was right in restoring the penalty under Section 271(1)(c) when sworn statements indicated the income was earned by the appellant's father and invested in the appellant's name? 2. Whether the Tribunal was right in restoring the penalty under Section 271(1)(c) when additions were made solely based on an offer by the appellant's father made in good faith to avoid litigation? 3. Whether Explanation 5A to Section 271(1)(c) is applicable when there was no departmental finding that the assessee owned undisclosed money, bullion, jewellery, or other valuable investments, and additions were made only on the father's offer? The assessee argued that the penalty should not have been restored, as the income belonged to her father and was invested in her name, and the additions were based on a good-faith offer by the father to avoid litigation. The revenue's contentions are not explicitly recorded in the judgment.
