THE COMMISSIONER OF INCOME T vs. SHRI SHARAD VASANJI
What did the High Court hold?
The High Court dismissed the appeal filed by the Revenue. The dismissal was based on the Revenue's submission that the appeal was not being pursued due to low tax effect, in line with CBDT Circular No. 17/2019, which increased the monetary limit for filing appeals before the High Court to Rs. 1 Crore. The Court noted that the tax effect in this case was below the threshold limit. Consequently, the substantial questions of law framed were left open. The Revenue was granted liberty to seek restoration of the appeal if the tax effect was found to be above the threshold limit, for a decision on merits. No costs were awarded.
What were the facts?
The Revenue, represented by the Commissioner of Income Tax, Chennai, filed an appeal under Section 260A of the Income Tax Act, 1961, against an order dated 20.02.2015 passed by the Income Tax Appellate Tribunal, Chennai 'A' Bench. The appeal pertained to assessment year 2008-09. The core of the dispute involved the deletion of an addition of Rs. 4,31,73,805/- made by the assessing officer towards long-term capital gains, which the Tribunal had held to be gains from agricultural lands. The Revenue challenged the Tribunal's finding that the lands were agricultural, citing conflicting certificates from the Village Administrative Officer (VAO) regarding crop cultivation.
What were the issues?
The Tribunal was required to decide three substantial questions of law: 1. Whether, on the facts and circumstances of the case, the Tribunal was right in deleting the addition of Rs. 4,31,73,805/- made towards long-term capital gains, holding that the lands were agricultural lands? 2. Whether, on the facts and circumstances of the case, the Tribunal was right in holding that the lands were agricultural lands, especially when the first certificate issued by the VAO clearly shows that no crops were grown on the said lands? 3. Is not the finding of the Tribunal perverse by relying on chitta adangal extracts issued by the VAO subsequently without mentioning the period, which was different from the chitta adangal extracts obtained from the VAO by the Department at the assessment stage wherein it had been clearly stated that no crops were grown in the said lands? The Revenue contended that the Tribunal erred in holding the lands as agricultural, pointing to an initial VAO certificate indicating no crops were grown. The Revenue also argued that the Tribunal's reliance on subsequent VAO extracts, which did not specify the period and differed from those obtained during assessment, rendered its finding perverse. The judgment does not record specific arguments from the assessee's side.
