What did the High Court hold?

The assessee sought permission to withdraw the appeal. Consequently, the High Court dismissed the appeal as withdrawn. The substantial questions of law were left undecided. No costs were awarded. The judgment does not contain any findings on the merits of the substantial questions of law raised by the assessee, as the appeal was withdrawn before any adjudication on those points.

What were the facts?

The assessee, Sri. Abdul Baqi Hasan Ali, filed an appeal before the Madras High Court against an order dated 19.6.2017 passed by the Income Tax Appellate Tribunal (ITAT), Chennai 'C' Bench. The appeal concerned the assessment year 2010-11. The ITAT's order was challenged by the assessee. The amount in dispute is not explicitly stated. The procedural history involves the assessee filing an appeal under Section 260A of the Income Tax Act, 1961, after the ITAT passed its order.

What were the issues?

The Tribunal had to decide the following substantial questions of law: 1. Whether the interpretation of Section 54F of the Act by the Appellate Tribunal is correct in denying tax exemption for the creation of a new asset used as a residential service apartment. 2. Whether Section 54F of the Act prohibits the claim of tax exemption for a residential service apartment, considering the residential purpose envisaged therein. 3. Whether the Appellate Tribunal was correct in entertaining additional grounds of appeal filed by the Revenue, which treated the sale of the original asset as two components (building as short-term capital asset and land as long-term capital asset) for capital gains tax, contrary to the Assessing Officer's assessment of the original asset as a long-term capital asset. 4. Whether the Appellate Tribunal was correct in treating income from the new asset as business income, despite the Assessing Officer assessing it under 'income from house property', to consider Section 54F(2) of the Act. Assessee's Contentions: The assessee argued that the ITAT's interpretation of Section 54F was incorrect regarding the residential service apartment and the treatment of capital assets. The assessee also contended that the ITAT erred in entertaining additional grounds from the Revenue and in reclassifying income from house property to business income. Revenue's Contentions: The judgment does not record specific contentions made by the Revenue.
